I-751 Submission Guidance

Hi all, I’m almost finished putting together our I-751 packet and looking to send it off on 7/7/23. I’m a little anxious and just looking for some reassurance/guidance on a few things. I made an embarrassing mistake with the fee amount when we applied for Adjustment of Status in 2020 so want to make sure. I’ve included the cover letter with list of included materials, any guidance is much appreciated: 

 

  1. Submission date: My conditional green card expires on 10/4/23. I calculated that 90 days from then is 7/6/23. I’m planning to send on 7/7/23 to be sure and I also have the afternoon off from work
  2. Fee: I am enclosing a check for $680 ($595 application fee + $85 Biometrics). Does that sound right?
  3. Filing Address: We live in Virginia and I’m planning to send by UPS to USCIS, Attn: I-751 (Box 21200), 2108 E. Elliot Rd, Tempe, AZ 85284-1806
  4. Address on file with USCIS: We moved apartment since our AoS application in 2020. I tried to update the address that USCIS have on record but never got confirmation. Does that matter for a I-751 application that we are submitting physically? 
  5. Utility Bills: We decided to not include utility bills as they seem pretty flimsy proof and are laborious to obtain. Should we try to include them? 
  6. Joint bank account: We don’t have a joint bank account, does that seem like a major red flag?

Enclosed please find attached Form I-751 and materials to support removal of conditions on residence for the Conditional Resident. 

 

I have enclosed the following items in support of our application for your consideration: 

 

Table of contents

  1. Check for $680 to cover filing fee and biometrics appointment fee

  2. Form I-751 and Form G-1145

  3. Copy of the conditional resident’s Permanent Resident Card 

  4. Evidence of bona fide marriage:

    1. Copy of certified marriage certificate

    2. Copies of joint-filing tax statements for the previous two years (2021 & 2022)

    3. Copy of our home rental agreement with joint occupancy

    4. Proof of Conditional Resident’s inclusion on U.S. Citizen’s health insurance

    5. Proof that the Conditional Resident’s life insurance designated beneficiary is U.S. citizen 

    6. Proof that the conditional resident’s 403(b) retirement plan designates the U.S. citizen as the sole beneficiary

    7. Proof that the U.S. Citizen’s 401k retirement plan designates the Conditional Resident as the sole beneficiary

    8. Flight information for trips taken together and upcoming planned trips together 

    9. Photographs of U.S. Citizen and Conditional Resident with table of contents

    10. Sworn affidavits from conditional resident’s brother-in-law and a friend

Timeline

Your earliest filing date is correct.  Your fee is correct.  Evidence looks good to me (joint bank statements would be good, too).  Utility bills are good evidence if they show both names at same address. Good luck.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thanks, really appreciate the feedback. I tried utility bills but I seem to only be listed as having permissions on the account and don't actually show up on bills or official docs. Tried calling but utility companies where I live have notoriously bad customer service so I'm feeling like focusing on other stuff

It's fine if you're listed as having permission.  You said, no joint bank accounts- just highlight on the bankstatement the utilities- coming either from your or your partners acc.they should show same adress so that's good proof, too.
