Technically, they cannot deny him the right to work.  It's considered immigration discrimination.  If he showed his passport with valid I-551, it's a List A proof.  He could have filed a claim with the Department of Justice.  

 

I realize in this case, it turned out not to be a big deal because he got his social right away, but it's a violation of civil rights and is important for other LPR's entering the US to know.

Hi, Can any one please confirm me at US immigration website it is clearly mentioned that police certificates are valid for 2 years unless do not return to that country after issuance of police certificate. I submitted police certificate from Pakistan which was issued on Dec 2022 but it was mentioned on that police certificate valid for 6 months so should I need to bring new police certificate in interview ? or not? I never visited to pakistan after issuance of police certificate but validity is mentioned on that police certificate is 6 months. can any one please confirm me?

Police Certificates from Pakistan are not accurate, and they are not needed for consular processing.

Hi everyone I have a question Once we get IR1 visa approved .Can I go to my home country from Canada and enter US from there?

 

As I am planning to go to my home country from where I will directly come to U.S and then come to Canada to pick up by belongings via road. 

Will there be any issue?

As long as you enter before your visa expires and your US spouse is either already in the US or is accompanying you, there should be no issues.

what’s the current wait at Montreal for interview after DQ for CR1 visa? I got DQ by the NVC on February 6, 2024 and would like to know when shall I expect my interview to happen.

Should i upload the recent version of i864 and upload the following documents before attending the interview: 

1. I864 (recent)

2. Income tax return 1040 and W2(year ending 2023 and year ending 2022)

 

Required documents 

 

1. Passport

2. 2 pictures

3. Medical report-submitted directly (got the Vaccination work & Information sheet)

4. Birth certificate

5. Marriage certificate

6. Police clearance/s

One photocopy is enough for each document or anything else is required for the interview?

In addition to uploading, also carry 2022/2023 tax transcripts/1040 and W-2 to interview just in case they ask for it. 

No 3 item in the list is not required but you may carry

Generally they look at the original documents during interview and keep the original police clearance certificates. Photocopies are not required for 1 thru 6.

Back again!

We just received a I-797C for biometrics this morning - husband has been in the US 43 days by this point. I don't recall seeing anything about biometrics after entrance to the US but there's so much information out there that its hard to keep track. Normal thing?

It happens sometimes.  It was probably a faulty machine or something at POE.  Here is a thread which regards one such case with @zeljuu

My husband was told at his POE that he could work, but some employers would need the physical card if they use E-Verify. In Florida, Beginning July 1, 2023, Florida requires all private employers with 25 or more employees to use E-Verify to determine a new employee’s eligibility to work in the United States. Luckily his only took a week after crossing to arrive at our house. He did apply for the SSN with his Immigration application.

E-Verify instructions state explicitly that if an immigrant has applied for a SSN but hasn't yet received it, make a note on I-9 and continue to allow the employee to work.
