I-131 and emergency AP

Hello all,

 

I'd like to hear from people who might've encountered situations similar to what I am about to describe:

 

My wife's parents are here in USA going through an adjustment of status process: she is a US citizen and they came initially on a tourist visa from Ukraine.  Due to the dangers of them staying there during the war, we filed the green card applications for them, last December.  As a part of the process we filed the I-131 to be able to travel in case of an emergency prior to getting a green card.

 

However, it is taking a very long time to process it.  And now, both of my in-laws are due to surgeries at their hospitals back home and we are considering scheduling an appointment for emergency advanced parole.

So here are my questions on this process:

 

1. Will getting an emergency parole have any effect on their previously files regular parole application?  That is, will it continue at it's own pace or will it be canceled because  they got an emergency parole?

2. I read on some sites that the likely period of the emergency parole is 30 days.  That might not be enough time for them to travel and have their surgeries and allow for the appropriate recovery time, so that their trip back is safe.  Getting train tickets from Warsaw to Kyiv alone is likely to be 20 days in advance.  How likely are they to get at least 3-4 months on the emergency parole?  Anyone have their own stories to share?

3. Does the time of the parole starts from the interview day?  Both surgeries are scheduled for the end of June, so should we call the immigration close to the day of the surgery?  That has a problem of getting all the traveling plans arranged in very short time.  Is there a chance, that the immigration officer would be able to grant the emergency parole starting with the date in mid June if we have an interview now?

4. Does it have any impact on their normal green card application process?

I am sure people are going to think it is odd going back to a war zone when they could have treatment here, but putting that aside.

 

All time lines are at best what seems to be the norm, AP taking 8 months?, I have seen quicker I  have seen longer of course what matters here is your precise timeline and nobody knows that.

 

So filing in December and expecting AP by June was optimistic.

 

You can seek to expedite AP but even if approved I am not sure it would meet your timeline, I am not even sure it could be reviewed in your timeline, that seems to be taking around 2 months, exceptions on that as well.

 

I have not seen many Emergency cases, and all the ones have been for a short period and have been cases where people have their bags packed and need to go now.

 

They can of course stay and go through Consular processing, probably Warsaw, or come back on U4U and go through adjustment again.

Sorry I didn't reply earlier.  Thanks for the info.

 

I have an update on this case.  We called USCIS and instead of scheduling an emergency parole appointment they filed the expedited AP.  Father in law got his AP within two weeks.  However, the mother's in law case is still stuck in processing.  Last time we checked, we were told it's in "adjudicated" status.  Is there a reason to expect it to be resolved soon or it may still take a while?  It is probably okay to reschedule her surgery by a month or so, but we'd rather not delay it too much.

As far as I know and seen there is no way of knowing.
