Also as per below screenshot from instructions for I1040 from IRS, with me as a spouse (not U.S Citizen not living in the U.S and not filing taxes), she should still file taxes?

Also will I need (as applicant) to submit PDF copies of the civil documents now in the process of NVC or just prepare them for the interview at the consultancy?

Hello everyone,

 

My spouse is about to submit her i864 so she had some questions we are hesitant about, if you can please help us with answers to these! her questions are as below:

Question #1: In Part 5. Sponsor’s Household size: I'm filing for my spouse as the principal immigrant, so it auto populated automatically the count "1" in Part 5 Item #1 , but there's a question in item #3 if you're currently married enter 1 for your spouse however if I did then I'm counting my spouse two times so it gives a sum of my household of 3 not 2 (including me) which is not accurate, should I leave item #3 blank? Cause if I entered 1 it will give incorrect number of household and if I put 0 it means I'm not married and I'm married.

 

 

Question #2: In Part 6: Sponsor’s Employment and Income: Should i put income of my Egyptian husband who's working in Egypt in item number 8 in Part 6 or leave it blank? It says in the instructions of the form that I must provide evidence that his income will continue from the current source after obtaining lawful permanent resident status which will not happen as he'll leave his work to travel.

 

Question #3: In Part 6: Sponsor’s Employment and Income: Should I Include my brother (that I'm dependent on in the tax returns and I’m attaching his tax returns as proof) support as income in Part 6?

 

Question #4: Required Financial Documents to be submitted on the website: I have left my job since May 2022 and I’ve been working for eight months in Egypt and I can’t get an employment letter from my Egyptian employer to prove any income during this period. However, my income is below the income tax needed to file taxes (1,645 $ per year in Egypt) and I’m not paying taxes so I’ll just prepare a word document and state the case, and I’ll sign on it and I will attach my brother who’s been filing taxes and putting me as a dependent to prove that I don’t have to file taxes also I will attach a form that I’ve completed an online test from IRS website that gave me the results of “you don’t have to file taxes for 2022” as proof, will that be enough for my financial evidence?

 

Question #5: My other brother will be our joint Sponsor as I'm not making enough money to sponsor my husband, should he file I-864 or I-864EZ? He's currently sponsoring only his wife who he brought to the US which is also Egyptian and has a green card.

Timeline

1.  Read the form carefully.  It very clearly says do not count any person more than once.  Item 3 should be "0". 

2.  No, you cannot count his income. 

3.  Joint sponsors must submit a separate I-864.

4.  You are not exempt from paying taxes just because you are a dependent on someone else's taxes.  On your I-864 or in a letter, you must indicate why you are not required to file. 

5.  I-864

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Can you please this attached file from IRS Interactive Tax assistant? It says I shouldn't file taxes, is this true or I should file?

 

And if not, how long does it take to file taxes and get a tax return to be submitted? Like we need to submit today or tomorrow the documents that's the point.

Do I need to send the submitted civil documents for me as an applicant to NVCElectronic@state.gov? or just submitting and uploading them in the website is enough?

If your income is below the filing requirement (after converting it to USD), then just write "below filing threshold" on the I-864.

Yeah but sometimes it's confusing cause I'm married filing separately but my spouse is not filing taxes cause he's Egyptian and he lives in Egypt.

 

So I'll attach this result to explain that yes I'm married filing separately but my threshold is not 5$, I have another threshold cause I'm dependable on my brother taxes.
