DCF request unanswered

Hello,

 

My husband is a USC who has been living in France for 8 years. We've been together for 4, married for 1.

He recently got a job offer April 26th for a new position in the US starting May 15th.  

That same day, we contacted the embassy in Paris to file DCF on the exceptional circumstance of short notice job relocation, sending all the required documents as well and have not heard back yet. He is now due to leave in a week and I'm unsure of what to do. We have emailed them again yesterday but still no response. 

Is it possible they would schedule a date for him to file the petition after he has relocated ? Or has anyone been rejected from a DCF, even though we seem to fit the exceptional circumstances ? Thank you.

I think the official rules state that residency may be a requirement, often times it is. I didnt do the DCF in France, but I had to petition while having a residency visa.

He does have residency, it's just that he has to relocate in a week and we haven't heard back yet.

I understand that. I was just thinking about your point about filing after he relocates.

Thanks. We want to file before he relocates, it's just the embassy isn't responding to our request so I'm wondering what our options are if they stay silent until he leaves. Stressful, but hopefully we will hear back from them within the week.

No, still no news even though we've been sending follow-up emails daily for the past week.

We're at a total loss for what to do.

Unfortunately, if he moves to the US before they respond he will have to file via USCIS.

As the first step of DCF involves the USC going to the embassy to submit the I-130 (he cannot file from the US and you cannot file the paperwork for him)....

Update: The embassy finally responded yesterday and accepted our request to DCF, giving my husband a meeting in June for him to file the I-130.

Really happy to hear the great news! Your husband's new job starts on Monday though, so was he able to work out delaying that start date or will the embassy not mind him flying back for the June petition date?

He is starting remotely and will leave after the meeting.
