Can Birth Tourism Be Negative? [split topic]

Hi friends:

May I ask about theoretical situation.

 

A woman gives a birth on B1/B2 Tourist visa in the US. She has multiple entrance visa for 10 yrs.

In the future, when time comes for reapplying for US tourist visa, can visa be denied based on the history of giving birth in the US?

How will Consular service know that one of the babies was born in the US in the past and it happen when mother travelled 

to us on B1/B2 visa?

Her chances of being successful in the reapplication are slim to none however it’s only $160, won’t break the bank. Back when I was in college a couple decades plus ago and college students from my country used to come over for the summer (ostensibly for a vacation but in reality to work illegally), my great friend a year boy junior applied for a US visa four times in the span of a month. Back then there were no wait times nor electronic interview scheduling, you simply go in the early morning to join a queue. 

 

After three refusals, on the fourth occasion the consular officer upon seeing him exclaimed you again and issued him the visa with the “warning” he should make sure to return to complete college. He currently lives in Virginia, legally 😂. We always joke about his persistence.

How will the tourist pay for the birth, without health insurance?

Is this person theoretically  planning to lie in the section of the DS160 that asks for names, and date and place of birth of her children? If so, they should be informed that very factually this would be material misrepresentation that could bring a lifetime ban from the US.


As to whether she will be refused, who knows. It’s not illegal to travel to the US to give birth, but it’s frowned on. Maybe she’ll get it, if her ties home are strong enough. Maybe they’ll refuse. Maybe they’ll give it but flag her file that CBP shouldn’t allow her in if she’s pregnant. Maybe they’ll tell her to come back and apply for a visa again when she’s past childbearing age.

Hopefully so, and hopefully they will have enough, because we have seen before people being refused visas because they still owe hospitals from giving birth in the US. Or you could be just refused in future. Wouldn’t that be a horrible outcome, you give your kid US citizenship but you can never go visit them once they move there?
