B1/ B2 visa query

Hi everyone,

i am a British citizen and my wife is on uk souse visa valid until March 2023.

I am preparing to apply for B1/B2 visit visa for her .

i need your expert advice on the question from DS-160 application form. The question is attached  , as you can see.

my question is that, as she is on UK spouse visa,

will she be considered as uk permanent resident or Not?

 

can somebody  please help me with this question i will be very grateful to you.

If you qualify for ESTA, why are you going for B2 visa? That’s just denial waiting to happen.

I am applying B1/B2 for my wife and she is not British citizen. She holds pakistani nationality but living in the Uk on spouse visa

No, she does not have ILR, but she is on uk spouse visa

So ILR is the equivalent to US LPR (green card/permanent residency). If your wife doesn’t have ILR I’d pick no.

You don't apply for her - she applies for herself.  Her application will be adjudicated based on her ties to the UK.  She will want to be able to show strong ties.
