Hello,

I am the beneficiary from Canada and my partner (petitioner) is in the US. We are June 2022 filers and received our NOA1 on June 3rd, 2022. Our payment was already cashed.

My question is - we filled out question 38 on the i-129f regarding the i-94 even though I had LEFT the United States when my partner filed our petition. We did this because we followed the instructions packet very closely, in which it stated to provide the date of the most recent i-94. We must have missed the actual sentence on the form that said to fill it out if the beneficiary was currently in the US.

I have been looking at many, many different posts and have come across how others have had the same issue and were also confused by this. My question is, has anyone been accepted by providing the i94 despite the beneficiary not being in the US? Will this cause a major problem?

Can’t answer your question. But I just wanted to connect, I also filed in June! I haven’t received NOA1 yet, my package was just delivered yesterday to the lockbox. Best of luck I hope everything works out for you all!

Don’t worry, not a big deal at all and won’t cause issues.
