My girlfriend is planning to come to the US as an Au Pair on a J-1 visa in October. We’ve been together almost 1.5 years and plan on getting married. Upon extensive research it seems like Au Pairs may get terminated from the program once they are married. Are we allowed to apply for a K-1 visa DURING her Au Pair time so she can stay in the US with me? Thanks in advance!

I am assuming you have other plans as a K1 is a visa that allows you to enter the US and then marry.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Just a question:  How is she going to convince the Consular officer at the interview for the J-1 visa of her intent to return home after her program has ended -- a requirement to get any non-immigrant visa -- when she apparently has no intention to do so?
