 Hello everyone,

We received a mail from the embassy and part of what is included is the request for tax transcript. I have not filed my 2021 taxes but intends to file within the coming week.

Please I need to clarify something,  do they look at the total income/AGI or the taxable income to determine if one meets the 125% poverty guidelines?

Thanks for your feedback. Much appreciated.

They look at CURRENT annual income to determine ability to support a new immigrant.

Current annual income = most recent pay period gross income multiplied times number of pay periods per year.

Then provide some proof like an employer letter or paystubs and you can use the number they prove instead of what is on the tax return.

Okay thank you for your input. So it's either letter from employer or paystubs? I thought I have to provide both. Thinking of asking for the letter from the HR same week of interview.

Open the instructions for the I-864 https://www.uscis.gov/sites/default/files/document/forms/i-864instr.pdf

Scroll to page 8.

Read the first paragraph to see what the government says about it.
