Hi all, I'm a US Citizen filling out the i-864 for my wife (i-130) who is a German citizen. 

 

For the sponsor's mailing address and petitioner's mailing address - can I put my wife's German address? I am currently living with her and intend to until I can take her back to USA.

I also have a house I own in America, but I am currently not living there.

What is your status in Germany?  If you are only a tourist, you are visiting your wife, not "living with" her.  Also, indicating you live in Germany instead of the US, can bring up domicile issues.  I can think of no advantage to indicating you live in Germany, even if you do.

Facts are cheap...knowing how to use them is precious...

IR1/CR1 Process & Procedures is the sub-forum for visa process questions (including I-864) for spouse of US citizen.  Many members knowledgeable on the I-864 hang out here.  Bringing Family of USC is the sub-forum for visa process questions for other relatives (ie. other than spouse) of US citizens.

I have a residence permit card — i came to Germany in December 2020 and got my card in March 2021. I would imagine domicile issues wouldn’t arise for such a short time period. I’ve lived in California my entire life

I would still add my physical US address but a German mailing address. But if this would put me at risk of having domicile issues, i guess I’ll just put my USA house mailing address. Only thing is I have it up for rent and didn’t want them going through my mail

OK, but do provide plenty of evidence of your continued US domicile.

continued US domicile is about proving I intend to live in America for the foreseeable future. I purchased a house in 2020 and pay monthly mortgage, I have a Us company with monthly W2s, and other tax records.

 

But i think I will just put my usa address to avoid the hassle of additional paperwork

continued US domicile is about proving I intend to live in America for the foreseeable future. I purchased a house in 2020 and pay monthly mortgage, still have ATT service for my usa number, is bank accounts and only American credit cards. I have a Us company with monthly W2s, and other tax records.

 

But i think I will just put my usa address to avoid the hassle of additional paperwork
