Petitioner becomes US Citizen after beneficiary enters the US but before receiving Green Card

Hi,  

I have been panicked and worried about my son's case so really hope someone can help me on this.  I recently became a U.S. citien and was told that it might affect my son's immigrant status becuase he has not received his green card yet. His case timeframe as below:

 

05/04/2021             F2A Immigrartion visa issued 

06/03/2021             Petitioner passed the US citizen interveiw 

07/15/2021             My son Enter the U.S.

08/28/2021             Petitioner became US citizen

 

It has been more than 90 days since my son enter the US and we are still waiting for his green card. We have been really worried that it would be an issue becuase I became a US citzien before he receives his green card.  Any advise might be help. Thanks

That is not an issue. You were still an LPR when he entered with the F2A visa so all is good: https://www.uscis.gov/policy-manual/volume-12-part-d-chapter-2 "A person is generally considered an LPR at the time USCIS approves the applicant’s adjustment application or at the time the applicant is admitted into the United States with an immigrant visa."

Your son did actually receive a green card - a temporary one - as soon as CBP stamped his immigrant visa for entry. That is what the notation regarding a temporary i551 at the bottom of the visa means. Having a temporary vs plastic green card does not change his LPR status.

 

What does his case status say if you enter the receipt number from the immigrant fee payment at https://egov.uscis.gov/casestatus/landing.do

You didn’t answer this? 90 days is outside normal processing time. What does the case status say?

it shows immigrant visa fee payment received. I already sent an email to USCIS and waiting for responses. thanks

I have the same problem my son arrived in America in June and am still

waiting for his green card the plastic one .

Timeline

My son also arrived on Oct 9, we paid his visa fee in the Philippines before he left, until now the green cad has not arrived yet . Do they also send the Social Security by mail? I hope that its ok to post here as  it the same topic. Thank you for replying.

yes. My son received his SSN in two weeks after he arrived here

That is why I wondering why it has not arrived yet as they said 3 weeks after arrival. So you did not have to call or apply for it in the Social Security office?

no need to call, it will mail out to you as long as you paid $220 for your green card and you did check yes to the question related to SSN in the form DS260

Timeline

I went ahead and applied  a US passport for my son which I received the passport about two weeks ago . If I get any free money I will start N600 for him . Am not even thinking about the GC now
