about to file I-751, have few questions

Hello,

 

could someone please help clarify... thank you in advance.

My wife (Greencard conditional) expires 12/30/21, came on K1 in 2019 March, got married to me (US Citizen)

 

1. so, on the I-751 application, the petitioner is my wife? and the spouse information is about me (US Citizen)?

2. we like to file by end of next week, end of October, which leaves about 60days before her conditional greencard expires. so are still good with the "within 90day period"?

Correct.

 

Very  very little has to do with the US Citizen on this petition, other than thespousal information section and then of course on the evidence provided (both of your names should appear on the evidence you provide)

The Green card holder is both the petitioner and beneficiary, the USA based spouse is only the spouse. Sign i751 accordingly; the spouse only signs the spousal section the green card holder signs everywhere else.

Yes you are good, even If USCIS received the i751 the same day the green card expires you would still be okay with timely i751 application.

Correct. She’s the petitioner and the beneficiary. 
There is a very thorough and complete guide for I-752 here in VJ. Read it. Make sure that the evidence you send include the whole period of your marriage. Prepare your package, and make a copy for your own records. I might be OCD, but apart from a physical copy I encourage people to keep a digital copy of everything sent to USCIS.

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!
