Criminal Conviction while Awaiting Adjustment

Timeline

This one has me stumped:

 

K1 visa approved.  The petitioner has previous criminal convictions.  Petitioner also has current charges (felony and misdemeanor) pending trial. 
 

Foreign fiancée arrives, and marries petitioner within 90 days.  Files for AoS.  
 

Trial for the current charges occurs during the AOS waiting period.  Petitioner is convicted of all charges and is being held until sentencing (later this year). 
 

What happens to the foreign spouse (K1 recipient)?

I would imagine the foreign spouse would have an interesting AoS interview.

Timeline

Since USC can not work after going to Jail/prison,  i would think they need to look for a cosponsor along with a lot of other things the USC needs to do to support the immigrant't 

place to live

food

money for essentials 

 

if i was immigrant,  i would go back home (just my opinion but if the person moved here to be with USC,  that won't be possible)
