I-864A husband of joint sponsor

My husbands sister will be our joint sponsor. She is married. My us partner who is the sponsor without enough income,

will be at another adress. So petitioner and sister are not part of a household.

Does his sister's husband have to fill out form I-864A since they file taxes together?

Yes, if his income is listed on the IRS transcript OR will contribute towards sponsoring your husband.

 

However, if they file taxes separately or his income won't be used, he doesn't need to fill anything.

Sorry but....... I am still not clear about the form. Does the sister's husband need to fill out form I-864A? Or not, since his income will not be used?

Even though he and the joint sponsor file taxes together and are not part of the household of petitioner.

Best practice is for husband and wife sponsors to both file forms.  The one with the greater income does the I-864 and the other, the I-864a.  This is a serious contract they are signing.  Consular Officers almost always require both to sign.

Facts are cheap...knowing how to use them is precious...
