Hello,

Hope you all good!

I would like to know something please.

I am currently in the AOS process. I sent my documents on May 17th and I received my appointment for the bios next month but I also received an RFIE for Tax Return because my wife does not earn enough. Now I have a question.

I have two people who want to sponsor me, the brother and the mother.

Is it better to include two people rather than one?

 

Do they add both? If the first one does not earn enough and the second too, will they take both and make a result and it is good for them?

 

And especially for example, If over the three years of tax return there was much more than the 125 of poverty but this year the person lost his job and the salary is less yearly than the 125, how is it going?

You only need 1 that qualifies. If your spouse doesn't qualify, then you need 1 joint sponsor that qualifies by themself (or with the help of a household member).

 

I remember someone that sent 3 sponsors (they all qualified by themselves) and got a RFE because the IO was confused.

Thanks, do they take in count the salary or the tax return?

They take in consideration all the income before any deductions.

Last question, when you put annual income like we are in July, the sponsor need to put what he except to win before the end of year or now?

Annualized based on what is expected for the next 12 months

No, it is the next 12 mos. from whatever month the affidavit is being prepared forward.  If preparing in July,  then July to June.  It is not restricted to a single calendar year but a 12 month forward look.
