Good evening everyone, I hope this the correct thread to write under. 
 

My mom recently had her visa interview at the us embassy in bogota Colombia on June 16,2021. They kept some documents such as, her birth certificate, marriage certificate to my dad (her husband), my dads divorce certificate from his previous marriage, Colombian police record, and her 5x5 visa photos. The consular official wouldn’t answer any of my moms questions and simply asked for her email and handed over a white 221g slip. No further documents are requested. oh and then after the interview my mom realized that they placed a random sticky note on the front of her passport with a date of dec 4,2021. She has no idea what this means. 
 

My mom has been living with us in the states for more than 20 years, she has no one in Colombia. The lawyer never even mentioned this as a possibility. We are all devastated. 
 

How long will this process take? any advice  or experience  would be greatly appreciated. Thank you.

She had a 20 year overstay, and the lawyer never mentioned the need for a waiver, or that she could be denied?

No not at all. She got the forgiveness and he was confident in sending her. Said he doesn’t see a problem in her obtaining her visa. When I informed him the news he said this has been happening in the last 30 to 60 days, that it’s just a background review including fbi checks, etc. But that he doesn’t see a problem, and that it should be resolved within 30 to 60 days. However I’m afraid it may take more or that they won’t give her the visa.

So she was approved for an I 601A?

Probably just regular AP, wonder why an I 212 was needed,whether there was anything else that a I 601a would not waive.

Sticky means nothing, as far as I know this Consulate is not known for long AP.

In some cases, the processing for AP  take weeks while for others it may take several months. If there are no additional documents needed and the consulate does not need additional information, the case can typically be processed and resolved within a 60-day period. 
Then the passport was returned to her by the consul? 
Why did she have to present the two waivers?

No I just realized that the other waiver which is the I 212 was from 1994 when she tried to do her papers with a different lawyer.  And what I was saying was that, the consular officer didn’t keep her passport. When my mom left the interview she noticed a sticky note with a date on it of dec 4 2021. No idea what that means.

I understand.  So it was just the I601A?  and it was approved.  With what you comment, there is only patience to wait.  Constantly check the email and after 90 days if she has no news they should ask.  The sticker in the passport does not indicate anything.  According to many cases, en Bogota they usually keep the passport.  Good luck in what follows. I know what these separations mean. The lawyer should investigate and give a more exact answer.

Thank you. Yes we asked the lawyer. But he keeps saying to wait at least 60 days. This is crazy. My mom went yesterday to to pick up her medical records and she said there was soo many people there in here same situation, a lady she met was there worried because she has no one there and is running out of money to pay her hotel stay and on top of that is with her 2 young kids, while her husband is in the U.S. it’s absolutely terrible.

If it is a very unfortunate situation ... and the worst is insecurity, one would like to know right away what happens but the good thing is that they have been denied it.  So much faith in God !!
