Hi all, my husband and I are considering filing our I-130 online whilst we gather more evidence for my AOS , my question is with an I-130 is there an interview for this filing and how much evidence do we need to submit ?

@NikkiR123, you can submit your I-130 online first and your I-485 later. If you include your I-130 NOA/Receipt, USCIS will consider your filing concurrent. 

By the way,  you want to include as much evidence of bona fide marriage as you can with your I-130 application. Your evidence would start since your two met or started dating. You want to show longevity here. Sometimes people only submit evidence since the date of the marriage. Then, it may look like you met on Monday, got married on Wednesday and filed for AOS on Friday. 

 

As of late, USCIS has been approving quickly I-130s submitted online - within a month or month and half, by the way.

06-15-2021 - Case was updated to show fingerprints were taken. 

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.

No advantage to filing them seperate.

@NikkiR123, I meant to clarify that there is no guarantee that USCIS will adjudicate your I-130 promptly if you submit it online. It's happened to some people, though. The nice thing is that you would get to your adjustment of status interview with your I-130 already approved.

We decided to file our I-I30 online cause we feel we're comfortable with that and because I'd like to have my medical submitted with the I-485. We're were together 4 years before we got married so we have lots of evidence showing the history of our relationship. Thank you again for your advice, much appreciated.

In this situation,  the i130 processing time is meaningless.   If the i130 has not yet been adjudicated by the time the i485 comes up for interview,  they will do them TOGETHER.   The i485 is the most important application to get filed ASAP.  You can show all the bonafides at the interview.  All you are doing is  delaying,  delaying,  delaying by trying to add stuff you can address later.

It's doesn't matter how long the I-130  takes , we have decided this is the way we are doing it , it's NOT delaying ,it's what we've decided to do  , if they do them together ,then they do , if the I-130 get processed first then it does. It's our decision.

USC4SPOUSE , I understand there is no guarantee , we have decided to go this route and I do like the idea that we could have our I -130 approved when we walk into our AOS interview, but if it doesn't happen that way then it doesn't . But we've decided to file to I-130 online . Thank you for your input , it's always helpful .

Your choice to delay approval of your greencard.

You're welcome @NikkiR123. I am glad that was helpful. The I-130 does require evidence of bona fide marriage and I just would include what you have. I would not wait too long before filing the I-485, that way you get your "place" in the queue. Then, when the interview comes, just bring the rest. 

 

You also have the option of sending your medical with the I-693 or bringing it to the interview.

USC4SPOUSE, thank you again , we are waiting a couple of months we submit the AOS . We're looking at sending my medical when we submit the AOS too.

Not understanding why you are so offended by OUR choice , it's not your green card . You don't know the circumstances of out case either . Again this is the choice my husband and I have made , it's really not for you to worry about .
