Filing online -- CR2 (step child)

When the petitioner files also for a step child (beneficiary, CR2), how does filling the forms and attaching attachments differ from the spouse beneficiary process? We are now so confused as the online form is all the time mentioning the spouse beneficiary... and when filing a separate petition for the step child, most of the questions are non applicable (such as work history for a baby). In addition, should the CR2 application have all the same attachments than the CR1 PLUS extras such as the child's birth certificate?

The online (and paper) form I-130 is the same for all petitions for eligible relatives, so some sections will not apply in certain cases.  Just enter "Not Applicable" for those sections.

Follow the I-130 instructions on what to submit.  From https://www.uscis.gov/sites/default/files/document/forms/i-130instr.pdf --

 

"If your petition is based on a stepparent-stepchild relationship, you must file your petition with a copy of the marriage certificate of the stepparent to the child’s natural parent showing that the marriage occurred before the child turned 18 years of age, copies of documents showing that any prior marriages were legally terminated (if applicable), and a copy of the stepchild’s birth certificate."

 

No other relationship documents are required, unless there's a legitimate reason the above listed documents are not available.

I just filed i-130's for spouse and step-daughter.  Under the beneficiary page of the online form it askes.

"For whom are you filing this petition? Select the relationship the beneficiary has to you......."

If you select "Child" at that point, the online form alters the remaining questions to be more appropriate for a child beneficiary. The only really odd questions remaining for a child beneficiary, regarding employment and marital status, can still be answered factually.  The child is indeed unemployed and it is an important detail that they unmarried.  Other places where it is asking spouse (of the petitioner) and other familial relationships are relevant and can be answered factually.
