Hello, I'd like some advice regarding my situation if anyone can help. Basically me ex is the US citizen and I came to the US on a K-1 visa several months ago. We got married right away, but unfortunately things didn’t work out for a number of reasons she field for divorce.. We filled out the paperwork for the Adjustment of Status and work permit after we got married, but she never took me on interview .and I was victim of domestic violence ? I have few question , so can someone give us advice? Thank you for your help

1 What will happen to my immigration status?

2 After divorce how long I can stay in this country?

3 Is their any chance for me to stay in this country?

4. Is it possible for me to change my visa status into student visa?

Sorry things didnt work out for you.

The best advice I can give is to get in touch with a good immigration attorney who will be able to advise you better.

1 You probablly will be out of status.

2 Not sure but hopefully someone else will be able to answer,

3. There is always hope for you to stay. Chances are slim unless you were a victim of domestic violence.

4. Dont think you can change status to a student visa, you will have to return to your home country and apply for a student visa.

You need to speak with a competent immigration attorney. Filing for divorce and finalising a divorce are two different things, but what puzzles me is that you say she didn't take you to the interview. Was an interview scheduled by USCIS? And why would she attend if she is the US citizen and you are the alien? Or did this interview come up after your US citizen wife had already filed for divorce? Why didn't you attend. Also, what were her grounds for divorce? If she is as you claim an abuser, it is rather rare for an abuser to actually take steps to divorce.

If he was adjusting status based on his marriage to a USC, then the USC would have to attend the interview.

12/14/2006--- Mailed EAD App.

02/09/2005-------Sent in request to Congressional office for assistance with expediting EAD.

02/13/2007 -------- EAD Approved!

02/26/2007 - ------EAD received

Removal of Conditions:

05/12/2009 -- Overnighted application by USPS express mail (VSC).

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

Well of course jane2005, but a USC would have no reason to attend without the alien beneficiary.

if you came to the US to be with a woman that you loved then it would seem that if that love faltered that you would want to go back to your home country .. hmmm, is that really why you came here? because you loved her?
