AoS for retired parent: I-944 confusion

Filing an i-485 for my 66 year old mother, who is retired and does not have much in terms of income or assets. However, she is (and is going to officially become, once she gets an SSN) fully my dependent, and I have enough income to support her as part of my household, which the affidavit of support and attached evidence will demonstrate.

 

It appears that a I-944 does not make too much sense in my specific case. Of course, I am planning to submit one for completeness, but it will not include income or assets, and I am worried the whole AoS application could be denied as a result.

 

Anyone have any advice for me? Many thanks in advance!

We filled AOS for my MIL with I-944 lastyear in May. So the form is about her Just state the obvious and if it doesn't apply to her just leave it blank or write NA. If she is getting a pension in her home country write an estimate in $.

If she owns a home, write it too. 

We didn't send a copy of diplomas and we didn't get a RFE for it. We just put the name of the diploma and the esuivalent here.

we didnt send a credit report or proof that she doesn't have one either because she never lived in the US before so we left all that section blank.

I think that was pretty much it. Don't overthink it. Good luck

And it sounds like your MIL still received her greencard?  That's very encouraging to hear!  I have a couple of questions for you:

- Did you buy private insurance for her?

- Does her home country income which you listed exceed the US poverty line?

- Did you list yourself and/or your spouse as members in her household?

She hasn't received it yet, we are stuck after the biometrics for now 🙄😔

But I do have a friend living in Houston that applied for her parents at the same time and they got approved with similar files.

 

No we did not buy insurance for her. We wrote on the application somethinglike: My children who are US citizens are paying for my medical bills for now and I plan on getting a medical plan once I get a SSN.

 

No the home country income did not exceed the poverty line. I don't think they care about that. They care about your income meeting the requirements since you will be responsible for her

 

No we did not list ourselves in her household. 

Only list people living with her permanently back home like other children or spouse.

And back to the original question she should include her assets and income even if they are not significant, there is no de minimis exception.

The assets section of the form says: "Provide the amount of assets and resources available to you and your household members." So if you (or anyone else who is considered as part of her household) has any assets, you can include those there.

True but for somebody that came on a B2 and stayed because of the pandemic and adjusted their status 

Can you still get health insurance without it?

We've tried many places but couldnt get accepted

I would contact an Insurance Broker, NoA is needed to buy through the Exchange.,
