[National Visa Center] Should I give the NVC the exact I-864 form submitted with my original application to USCIS -- or a new, fully-current version?

Hello!

Quick question. I applied for a marriage-based greencard last summer and thankfully it is finally moving along in the process. USCIS has now forwarded at least part of the process over the the National Visa Center [NVC] who are now asking for the submission of:
 

  • An I-864 Affidavit of Support Form
    • Supporting I-864 Doc's
  • Completion of a "Online Immigrant Visa and Alien Registration Application (DS-260)" through their website

 

I think I know the answer to my question, but wanted to check anyways -- should I create a new I-864 form with fully up-to-date info in it, or should I send the NVC an I-864 form identical to the one I sent to USCIS last summer? 

 

For example, differences between the two would include a change of address.

 

Also, one more quick question: would I need to report my 2020 Tax Year income if I haven't filed my 2020 taxes yet?

July 2nd, 2020 - "I-485 + I-765 + I-131 Package" Delivered to Chicago Lockbox

August 5th, 2020 - Opened case through USCIS helpline about lack of any receipt notifications

August 7th, 2020 - I-485 + I-131 forms were officially "received" by USCIS (36 days after arrival!!! 🤯

August 6-13th, 2020 - "I-485 + I-765 + I-131 Package" Money Order Cashed at Some Point...

August 13th, 2020 - I-485 + I-131 Text Message Receipt Notices Received

September 12th, 2020 - I-765 Rejection Notice Received by Mail (Notice date August 3rd)

October 9th, 2020 - Resubmitted I-765 Received

January 13th, 2021 - I-131/ I-765 Expedite Request Received

January 21st, 2021 - I-130 Approval Notice

January 24th, 2021 - I-130 sent to Department of State [NVC]

February 11th, 2021 - Completed Biometrics Appointment 🙌

NVC does not handle Adjustment of Status cases.

Maybe I wasn't clear with my phrasing -- but USCIS has already approved my I-130. The Department of State / NVC is asking for us to supply some documents as a precursor to finding an interview date, not as part of approving an I-130. Is there still an issue after this clarification?

Yes, big issue. NVC needs to send back the approved I-130.

Do not submit that or pay those fees. That process is for Immigrant Visas, not Adjustment of Status.

As was said, they're treating you like you're an Immigrant Visa case, not as an Adjustment of Status case. Your case is not supposed to go to the NVC, so you need to contact them and let them know that they messed up.

The NVC asking you to supply those documents is the Immigrant Visa process and not something you should be doing as an AOS. It's not about the I-130 being approved or denied.
