Does National Guard members need to certify N-426?

Hi all,

Well, my situation is that I submitted my naturalization process on basis of military service. Therefore, I submitted my N-400 form along with N-426 form (military service certification). The thing is...TODAY I got a Request For Evidence (RFE) simply because I didn't ask in my unit for an O-6 or above to certify the N-426. Now they are asking me to reply with the certified document so they can process my case. But here is the thing, I was reading the instructions of the N-426 form and it says that IF you are separated from ACTIVE DUTY then you don't have to certify with anyone since you went to the reserves, which is our case of National Guard members, we go to the reserves component. I have my DD-214 here at home but before I submit I wanted to make sure what is the right thing to do because we only have one chance to respond a RFE or we might get denied. I contacted USCIS as well and I'm waiting on their response! Can someone please give me some light?

1/21/21 - Biometrics applied.

1/26/21 - Received biometrics reuse notice in mail. 

2/11/21 - Called for an update on my case and was told file is in local office.

2/26/21 - Received interview notice. Printed on 2/22/21.

 

N-400 - Military Service Based

1/12/21 - Application submitted online; Application received.

1/13/21 - Received IOE electronic receipt notice via email; Biometrics walk-in; Case status changed to "Case is Being Actively Reviewed by USCIS."

1/19/21 - Received paper receipt notice in the mail.

1/22/21 - Received email from USCIS that a new receipt notice will be issued due to an error on the previous one.

1/26/21 - New receipt notice posted on my online account. 
2/01/21 - New receipt notice arrived in mail. 

2/11/21 - Called for an update on my case and was told file is in local office.

2/19/21 - Case status changed to Interview scheduled.

2/22/21 - Interview notice posted on my online account.

2/26/21 - Received paper interview notice in mail.

3/16/21 - Biometrics Reuse notice posted online.

3/26/21 - Received biometrics reuse notice in mail. 

3/30/21 - N-400 approved; Same-day oath ceremony.

A Honorable Discharge DD-214 should be enough. 

 

"Veterans who are no longer serving may leave Parts 5. - 8. blank, but must provide their DD Form 214, Certificate of Release or Discharge from Active Duty, and/or NGB Form 22, National Guard Report of Separation and Record of Service"

 

contact military hotline at militaryinfo@uscis.dhs.gov to have them sorted this out for you.

Dd-214 will be just fine.

Just to update you guys on my case. The immigration officer actually called me and they said since I'm still in the National Guard and I drill once a month I still need my N-426 signed and certified. I got it back from my chain of command on December 31st and I already submitted to USCIS. Now I'm waiting for the USCIS to schedule my interview.

I submitted my application on November 18th 2020. I got a RFE because I needed my N-426 to be certified and I literally waited only for it from my unit. I got my document certified and on December 31st I already submitted it then I got my interview scheduled for February 10th, 2021. IT WAS SUPER FAST! If I didn't have the RFE I think I would have gotten my interview scheduled for January. And all military applications goes to Nebraska military center.
