N400 after VAWA 3 years

Hi everyone!

 

I received Permanent Residence based on VAWA in February 2018. I should be eligible to file for naturalization under the 3 years rule in November 2020.

I searched around but I don't really see the update case posted in this year, all the information I found posted a few in 2019 and mostly from older plus It's hard to find anything from USCIS website about it. Also there is no option for it when I look at the online application.

 

Could anyone confirm that I am still eligible to file for Citizenship under 3 years rule section 319(a)?

Do I need to attached any Policy manual when I apply for?

Is it possible to get a fee waiver? (The new rate fee is pretty heavy for me since I lost working hours from full-time to part-time due to Covid pandemic and school closed situation, if I can't get a fee waiver then I'll apply after I can work fully hours when my son physically go back to school)

12/15/16 I-765 Approved.

05/26/17 DS-3035 for Hardship waiver sent to DOS to complete I-612 case.

06/16/17 I-612 Received approval notice.

08/15/17 I-485 Case received

09/25/17 Finger print.

10/03/17 My case was transferred to another office for processing.

10/05/17 I got the mail said my case sent to NBC (My case status online is nothing update)

10/10/17 I-131 and I-765 renewal received

11/24/17 Received my work permit with Advance payrole.

12/18/17 I got the mail for my interview in January, 2018.

01/29/18 Interview.

Pick other basis for naturalization, put down "LPR for 3 years under VAWA, INA 319(a)". You probably do not need to attach the AFM or anything of the like but if you want to, you can.

 

Yes, you can get a fee waiver for N-400.

Contradictions without citations only make you look dumb.

You can NOT use the online system. For VAWA n400 you must send it on paper- the online system wont accept it the way you fill it out. Also if you are doing a fee waiver you also couldn't use the online system. You can send the package with your fee waiver. If they reject the fee waiver you will get a notice saying so and asking for payment. If you can pay it then pay it and it will move forward. If you can not then its OK. It will just be rejected and in the future when you have the funds you can send a new package. There is no penalty for sending it with a fee waiver that is denied. 

 

There are a few options for the fee waiver. Please read it carefully and choose the right one. If you get any kind of social services assistance- food, medical, etc- then you simply need to show proof of such. In order to get such benefits you needed to be at a certain income level. So USCIS will accept proof that you receive said benefits as proof you qualify for the fee waiver. If you dont get benefits and your income is low enough you can do the option to qualify based on income level. For that you basically send your taxes/proof of income. The final way is if your income is technically above the guidelines but you just cant afford it. For that you need to list out all your expenses and income and provide an explanation of the hardship. Then you would be subject to their discretion if you qualify or not.

I didn't know that I should submit a paper application and actually submitted my N-400 online and got the receipt notice both online and in the mail!! Hopefully it will move forward and they won't deny me after that. :(

This thread is from almost a year ago when the online filing system for n400 was still kinda new and the kinks being worked out. At that time VAWA approved petitioners couldnt use the online filing system as it didnt allow them to select the correct eligibility category or would bounce you out if you tried to enter info in the 'other fields'. It appears they updated the online system so VAWA approved N400 filers can use it- your NOA is proof they accepted your filing and I dont see any reason why they would reject it at this point.

I’m applying for my N400 too next year and would like to know what documentation is required.

Do we still need to send in proof of abuser’s citizenship etc.?

How long does the process take from application to approval generally?

It doesn't hurt to send your spouse's proof of citizenship if you have it on hand also either your marriage certificate or proof of divorce.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).
