Can a petitioner under any circumstances get a refund for the I-130?

Hello. I applied for my spouse a month back. The spouse has applied for a divorce. Is there a way to revoke my I-130 and get at least a partial refund at this point?

You can revoke your I-130 but they do not give out refunds for any reason.

If the cheque has not been deposited, you can stop the payment...

No refunds. If the check/money order/credit card was redeemed, then the money is gone.

The petitioner should write a letter of withdrawal for I-130 and send it to the service center that has the petition. If they don't know who has it, you can check your NOA1 or call USCIS and get an address.

The withdrawal reason and other details aren't needed really....the petitioner just has to state that they want to withdraw the petition. Provide the petitioner's full name + DOB, along with the beneficiary's full name + DOB. Provide the receipt number as well.

 

A withdrawal request cannot be revoked. It would require a new I-130 to be filed.
