Dissolution of marriage before GC interview. Do I do anything?

Hello VisaJourney,

 

I have just returned home to the UK from the US. I had gone through the K1 system to move over and marry my wife. Things had been very difficult with the work visa taking so long, the stress of not bringing in money etc. As well as along the way I think we both just realised we weren't ready. Especially the way the US system just pushes and condenses everything to happen so quickly, compared to your average relationship. Anyway my question is. Do I need to do anything on my end or does me ex need to do anything on her end? My interview got rescheduled for September just after I left. We have not thrown away the idea that after some time we may reconnect and try again, plus I would like to come over to visit possibly next year. Will there be any impact because I left ?

For a visit, I think you will have to reapply for ESTA or a B2 visa.  You abandoned your adjustment of Status, so your immigration journey has ended.  If I were your wife/ex-wife, I would take action to ensure the I-864 is officially withdrawn.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yes unfortunately, I know we would have to do it all again. But If it is meant to be then it wont be a problem. We will do it again, more prepared.

To piggy back on this since I’m not 100% clear  it’s quite possible you may not receive either visa as you’ve already shown immigrant intent If you are still married. Regardless even if you aren’t married it will be up to the individual processing your visa: I don’t think any of us could give you a guarantee. I personally would call and cancel your interview. If you think you may remarry (again I’m not clear) in the future and apply for Cr1 expect to be scrutinized but IMO it’s not a reason for denial. Since you’ve already left your process is over but for those reading this in the future think long and hard about your decision to marry - marriage is a lifelong commitment that shouldn’t be taken lightly and it takes even more strength, research and commitment While dealing with immigration. It’s not for those who want to get their feet wet.

Visa Received : 12/10/14 picked up at Jacmel location

US Entry : 12/15/14 Fort Lauderdale, Florida

Apply for Social Security Card: 12/30/14 Connecticut

Marriage: 1/26/15
