Hi team! 

I am an Aussie who came over on a K1 and have a pending AOS. My interview was meant to happen right before the Covid shutdowns and given I’m in Portland OR I think it will take a while for the interview to be rescheduled.

 

Given what’s going on right now my partner and I are thinking of bouncing and going back to Australia on the partner visa and going to uni back home, however these visas are taking up to two years to process at the moment, during which time we would want to be together and would stay here in the US waiting for the AOS (knowing if I left I would need to abandon the green card should I get my interview and apply from the beginning again if we want to come back.) 

 

My main question is has anyone ever had both of these visa applications going at the same time? Is it allowed?

If you're wondering whether USCIS cares if your spouse has a visa application for Australia, no they don't.

I don't think that USCIS would even have a way to know about you filing for a Partner Visa. I would totally do if that is what you want to do (I don't blame you).

And even if they did, it would be irrelevant.  There is no need to conceal it from USCIS or DOS.
