Hello All Vj Member,

 

Hope everyone is doing great.

 

I have a question regarding visa category initially when u applied pettiion I-130 and I got approved and USCIS sent ur case to NVC at that time it's show CR1 but I see people with visa category IR1. Some one told me it depends on the marriage time and if so then how we can change the visa category.

The category depends on when you arrive in the US. So if you've been married for over two years when you enter the country, you'll get an IR-1 and won't need to apply for ROC (Removal of Conditions). If you enter before your second marriage anniversary, it will be CR-1. So basically the category doesn't matter until you actually enter here (unless you've already been married for 2 years when you apply. Then it obviously defaults to IR-1)

There’s nothing you can do to “change the category”. If you have been married for 2 years or more on the day you immigrate, you will be recorded as an IR-1 immigrant and will receive a 10-year Green Card in the mail. If the marriage is less than 2 years old when you arrive, you will be recorded as a CR-1, will receive a conditional 2-year Green Card in the mail and have to go through the Removal of Conditions process in 2 years time. 
 

If you are very close to the anniversary when you receive the visa, it’s worth waiting until the second anniversary before coming here (assuming the visa is still valid). It saves the cost and hassle of Removal of Conditions. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Since the embassies are closed and you'll only be able to enter after your interview, you'll definitely be getting an IR-1 visa. Congratulations on the DQ!

Filing a petition for alien relative is just that.  There is no "visa category" directly associated with the petition, no box to check except "spouse".  The I-130 is also used in cases where NO VISA is being sought.

 

The correct visa will be issued when it is issued.  The correct immigration status will be granted once the visa is used to enter the USA.

Facts are cheap...knowing how to use them is precious...
