I-130 Wife Approved, Children got RFE

Hello, I filed my I-130 online for my wife and stepchildren. My birth certificate was attached to ALL 3 applications. But now I am getting an RFE for the kids application even though I can see my Birth Certificate in the online forms I submitted. Any ideas? Here is a copy of the letter:

NVC? This is an RFE issued by USCIS.

Is this a DCF case or did you file domestically? This was posted to the DCF forum but your timeline implies your case is being handled domestically (at TSC).

 

I understand the names are redacted, but are the names for both black boxes the same?

Basically, the second (last) blocked out name...is that the petitioner or beneficiary? Also, you were born in the US, correct?

It appears my Wife's application is moving on to the NVC yet USCIS is requesting the RFE. I thought they would approve all 3 and then match up later at NVC. Now I find out they want my Birth Certificate even though it's already attached.

Each petition is adjudicated separately. But yes, they can be matched up at NVC later (either automatically or upon request).

Sorry - yes contact USCIS since they are holding the 2 petitions.      

 

You are not a DCF if it was filed stateside.

UGH!! Not a DCF case. I was reviewing something in here. Can this be moved? 

I am the USC. Born and raised here in America. The top name is my stepchild and the bottom name is mine.

Gotcha...sounds like they overlooked something then. Nothing jumps out as incorrect, assuming it's a normal BC and was fine for your wife's I-130.

If that is the case, sending the BC copy again in response is probably all that is needed.

Great. I wanted to do that but was just double checking. I didn't want to assume they overlooked it.

Just for completeness, does the BC you sent contain:

• The date registered / filed
• Date and place of birth
• Names of parents

This seems pretty standard, but I don't know BCs in all states/counties. There is typically a "short form" and "long form" version, in which the short form may not contain all of the above.

One thing I noticed is the letters are different...

 

The first attachment says Certificate of Birth is Not Sufficient evidence..... However, if you look at the letter for the other child, that phrase is missing (see below)

Yes. It is the same BC I have used for my wife.
