Affidavit of Support-which form and extra docs

Hi everyone. I am about to submit the affidavit of support for my alien spouse. Per my household size, I have to have a minimum income of 55K.  I make a little over 80K before taxes and 72K after taxes. I have my tax transcript from 2019, 6 months of pay stubs, and letter from my empoyer. I also own some property and have some savings. Should I submit the affidavt 864EZ or the normal 864? And should I add info on my property and savings?  Not sure what is best as I don't have the option of a joint sponsor. Maybe I am overthinking.

If you meet all the listed requirements* you can use the I-1864EZ.   

 

Income will be your GROSS income (little over $80k).    If you are not a new employee you do not need an employer letter or pay stubs, also don't need to list your property of money in savings.    Embassy will want tax transcript.

 

 

 

EVIDENCE OF FINANCIAL SUPPORT. Applicants must provide evidence that they will not become public charges (that is, dependent on U.S. government welfare and assistance).   Form I-864 Affidavit of Support for visa applicants in the IR, F, certain E visa categories, and following-to join employment (E ) applicants, complete with copies of the sponsor’s U.S. federal income tax return (Form 1040) and wage statements (Forms W-2). The petitioner must provide an Affidavit of Support even if he/she has no income and even if a joint sponsor provides an Affidavit of Support reflecting sufficient funds to provide financial care. Download Form I-864 at http://www.uscis.gov/portal/site/uscis.

 

 

 *Form I-864EZ Affidavit of Support. A sponsor may use the shorter Form I-864EZ in place of Form I-864 if ALL of the following apply:

- The sponsor is the petitioner;

- There is no need for a joint sponsor or a Form I-864A;

- The affidavit of support is filed for only one intending immigrant;

- The sponsor seeks to qualify based on his/her income alone (not on the basis of assets); and

- All sources of the sponsor’s income are shown on Form W-2. Download Form I-864EZ at http://www.uscis.gov/portal/site/uscis

Sounds like I-864EZ, if it is employee W2 income.  $55,000 covers a household of 8.  No need for employer letter, but I would include 1 most current pay stub.  Note that your "current income" does NOT come from a tax return.  Tax returns are about the past.  Current income is your gross pay for one full pay period times the number of pay periods in a full year.  For example, if paid every two weeks, multiply by 26, or every week, times 52.

My 2019 tax transcript and W2s only show my salary from Sept 2019-Dec 2019 as I was living abroad until July and my foreign employer earnings were exempted. In this case, will my 6 months pay stub, 2019 tax transcript, and employment letter be sufficient?

Your pay stub, (Just one since it's going to show YTD earnings anyway) is sufficient evidence of "current income".  No need for an employer letter with a pay stub.

Thanks, do you think 25k above the requirement of 55k is enough? I have heard of some people getting rejected even when they exceed the amount and are told they will need a joint sponsor.

Yes, it should be enough unless your spouse is coming from India.  Mumbai expects to see three years of past qualifying income.  This is why it's so important to complete your profile and timeline.  That way you are "contributing" instead of just "taking".  😉

Great, spouse is coming from Egypt. Yes I updated my timeline and have posted an update for my fellow Sept filers in another group. We gotta do our part.
