A daughter's adoption was completed in the Philippines by US Stepdad, but he passed away before He could bring the family to US!

ADOPTION QUESTION! (ASKING for my Best Friend) Hey guys, I wanted some information if anyone went through or knew the process. My best friend has a daughter from a previous relationship and she married an American and then apparently her F adopted her daughter officially while in the Philippines. This girl then has all her documents changed to her adopted American dad including changing her last name to her American adopted dad. In her NSO Birth, it was official. The girl was only under 10 when the adoption got completed in the Philippines. Also, they have their own son. The American father was in the process of bringing the whole family to the US but unfortunately, he died of cancer. The mother(my best friend) did not know that she could apply for a widower visa at the time of her husband's death. Anyhow, she is still in the Philippines and her daughter. Is there a chance that her adopted daughter could apply for citizenship since she was adopted by an American citizen?

Her daughter is now over 20 yrs old and she asked what is her option?

I could not answer this as I have no idea about adopted parents passed away before he could bring the family to US.

Adoption would not by itself do anything, nor is it needed to sponsor a step child, moot now that he has passed.

No options.  She made no moves prior to turning 18 to obtain CRBA and passport.

April 6,2023 Legally Separated - Oh well

how old is the son?

if he is under 18 ,  he is eligible for Social security benefits if father worked enough hours to pay in

No that kid is not an adult.

thanks for your input. After this Covid, she said she will visit local US Embassy in Cebu Philippines soon.

I don't think the consular agency in cebu will be of much assistance.   The services at that office appear to be limited to USCs.

thanks for your input. they just needed someone to tell them what are their option. If they have nothing then at least they tried. thanks for your input.

In that case best to consult an Immigration Lawyer.

Respecting time was the key . . .

 

     If the husband died more than two years ago then there aren't any options for the mother.

     If the daughter didn't assert her claim to citizenship prior to turning 18 then there aren't any options for her.

 

. . . I have this battle all the time with my Filipina wife and those I work with there.

 

It's unfortunate; it was all preventable.

at the time of his death, wife was struggling. And I couldn't be there at the time. I adviced her to apply for widower visa and like she said, she couldn't afford it. 

 

Yeah it all too late
