I-130 IR-1 for Spouse with Abandonded Green Card

Hi everyone,

 

I am putting together my wife's I-130 petition and wanted to get your feedback about a couple things. This is not the first time I have applied for my wife. I applied and received a fiance visa for my wife. She moved to the US, we got married, she got a green card and then we moved to Japan in 2010 - 2011 (slightly offset from each other). We abandoned her green card in 2016 and received a copy back of the I-407.  (I actually made a new account for our new timeline since I can't make two timelines on a single account. ) 

 

Anyway, first question: Do you think the abandoned green card will have any affect on getting a I-130 petition approved? Getting the visa approved? And has anyone gone through a similar experience?

 

Second, I plan on filing online. Are there any pros or cons to this?

 

Next, here are the items I am compiling for the evidence of a bonafide marriage:

  • Child birth certificates (one born in the US and the other in Japan)
  • Last 5 years of jointly filed tax returns. Because we filed jointly when living in the US, I continued to file jointly living here. We do not make enough money to pay any US taxes.
  • I-407 Abandonment of Green Card document
  • copies of our Japanese Driver Licenses and translations (they show the same address)
  • Credit card statements and translations (x3) that show both our names
  • Pictures (x14) that span the last 5 years

 

I can provide a few other items but would require more translation so I am trying to avoid it: Family register from the local government, snapshots of conversations via Line, utility bills in my name, credit card statements in my wife's name.

 

Lastly, I do not have a job lined up in the US at this time. My plan is to submit this I-130 petition, start applying for jobs while I phase out of my job here. Around fall this year move myself over to the US (hopefully have a job) and get work as soon as possible. If I can time it right, I will have a job already by the time I have to provide my I-864 Affidavit of Support. While we do have some assets to use for that, having a job will make it a whole lot easier. Finally, bring over the children and depending on the timing my wife at the same time.

Her past immigration history should not cause any negative issues.  I think you have a sound plan in place.  Good luck.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
