hi to all members

this is a wonderful site for us with lots of great info. we followed every step metioned here to apply our k1 visa and now its approved. so i m waiting for my package to arrive.

just one question. Is it ok to get married while waiting for the k1 process. we both went back to our country and got married in a traditional way. its mainly for our parents and to enjoy the company there. My fiance who lives in US is not a citizen by birth. He is not registering our traditional marriage in US so that we could get married again there.

Will there be any problem during the interview or the visa process as we are married now.

Most traditional weddings in native countries are not considered official because they are not registered with the govt. Just family coming together and blessing the marriage in the native way. Young man, go ahead with ur fiancee visa and just don't mention it at your interview. Don't fret! I come from a country(not england) where traditional marriage is only recognised by your people that you are a couple but then you can't officially use the Mrs thingy yet. You still need to get married again in the U.S though to cover ur ###. Goodluck and I wish you all the best! :thumbs:

That's bad, bad advice unless you know for a fact that the marriage is NOT a legal one!!

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

She said it was a traditional wedding but has not mentioned if it was a legal one maybe just a religions one? To the OP please confirm if your wedding was a legal one / Registered marriage or whether it was only a religions ceremony? oh and also ... Please fill in your timeline. It helps us all. Thanks

i really really had no idea that we couldnt get married during the process...we were thinking that its no problem at all...just call me stupid or whatever...there is a cert that i m using to apply a residence staus for my fiancee who is a US citizen...so i guess i have no choice then to consult with the consular what to do next...

i dont know if there is a shortcut now to get going with the i 130? any ideas? if u were in my situation what would u do...

IS your marriage registered or not? The whole idea of the K1 being called a FIANCEE visa is just that...the requirements are very plain regarding the K1. It is for the purpose of bringing one's fiancée to the US to be married.

Did you read the information that comes with the K1 forms? Did either of you read any of the Guides listed here? There isn't a short cut with the K3. You are basically starting over from square one when filing for the K3.

So it was a legal marriage. Then yes, you have no choice but to start over with a marriage visa.

You could have done a a traditional wedding (in most countries, that by itself is not legally binding), and still remained legally un-married and able to use the fiance visa. A bit to late for that now.

You probably should inform the consulate/embassy that you had your interview at that you wont be using the K-1 and instead filing for K-3 or CR-1. You will have to go through another few months of waiting before you can finally come to the US. It will likely take longer to process than the K-1 did.

For ####### sake - don't tell Thaw to do something like call and cancel or start over again or take some game-ending action based on what anonymous people on a message board say! Thaw, don't be a dummy and act until you get more information. People here know what they are talking about many issues. But they are also frequently wrong or misinformed.

Thaw - do not do ANYTHING until you go consult with an attorney. Don't call any Embassy or USCIS or anything until you (or the USC if that isn't you) contacts a qualified immigration attorney to ascertain your exact status.

As mentioned, if you are LEGALLY MARRIED anywhere in the world, then you are dead in the water. But we don't know enough here to say that for sure. Go talk to a lawyer.

If you just had a ceremony, religious or whatever, and didn't sign documents, then you might not be legally married, so you're okay to go.

And sadly, ignorance is no excuse for you to use with the US Government. The visa for which you applied was called a "FIANCE" visa - there's a commonly understood meaning for that word. You should have known. Nothing you can do now if you are legally married, but yes, you should have known. Not to sound like I'm scolding you - but for anyone else who stumbles on this thread later on, they should understand that some common sense applied to common terms like "fiance" (as opposed to "spouse, " which has its own visa) will save you A WORLD of heartache and cost later on.

hey thanks ...really i think what u said was true. i cant just be ignorant and go through it....i should find out more and if i have to i will go with the k3 visa......but we were both foriengners there when we got married so i think they did not register us as married yet...let me find out more....b

I asked the OP twice if the marriage was registered and never got an answer....that will definitely make all the difference. I was trying to find this out you see....because if it's registered then they WILL have to start over. I wasn't one of those that advised the OP to cancel anything. I see now the OP has come back with more information.
