L1 while Fiance visa K-1 is in process

Hello!

 

I am not sure if this is the right place to ask, but I am in process for the Fiance Visa and actually I am at the stage where the Embassy has all my paperwork and I am waiting on their confirmation to book my interview appointment.

 

I recently informed my employer about it and they mentioned they don't want me to leave the company so they are offering me a position in the US with an L1 Visa (as they want to avoid having to wait for my AOS through K-1 which takes 5-6 months).

 

Does anyone have had a similar situation or know if it is possible to be in process for 2 visas at the same time and what issues this might cause?

There are others will a lot more knowledge than I on these subjects, hopefully they will agree that If you are going for a L1 then just forget about the K1.

No need to waste time.

I would look at L1 > Marry > Adjust Status

Your company can premium process the L1 in 15 days for the decision. If they also have blanket privileges then even easier route through.

 

Of course all this is dependant on your meeting the L1 criteria. My assumption is your company have checked this.

Check the forums I guarantee this has been asked before more than once.

L visas are dual intent, so I think the suggestion above to L1-marry-adjust is probably the best option. You can continue working (and traveling if you need to) on the L status while waiting for AOS

i just had a call with the immigration specialist and he confirmed what you suggest. :)
