Hey im brand new to all of this..I met this amazing girl from Jordan while we were in college together. she graduated in may of this year and she had to go back to jordan..I am going to jordan in september to ask her to marry me..anyway she still has a student visa thats good for two more years i think and she has a passport from england that lets her do anything she wants there including live and work...anyway i just needed to know what i should do first to start the process of getting her here?? I really appreciate any help...Thanks, Aaron

You know at first I was going to give you the normal steps but after thinking about it, I actually think I'd consult an attorney. I would hate to see you go through the utter hell that most of us in the Middle East/North Africa go through if there's a way for her to be here on her student visa legally. Seems like yours is an interesting case and I'd love to see what a lawyer would tell you. Good luck whatever you decide though. :thumbs:

First step is to read the guides.

Having a UK passport doesnt really matter in this situation. If she is in Jordan, she will go through the embassy/consulate in Jordan. The first thing you need to decide is what type of visa you want to get. Fiancee visa (K-1) is ussualy fastest, but there are good reasons to get a K-3 or CR-1/IR-1 depending on your situation.

First step is to read the guides.

Having a UK passport doesnt really matter in this situation. If she is in Jordan, she will go through the embassy/consulate in Jordan. The first thing you need to decide is what type of visa you want to get. Fiancee visa (K-1) is ussualy fastest, but there are good reasons to get a K-3 or CR-1/IR-1 depending on your situation.

My first reaction was to say read the guides too. However, this is a unique situation and the foreigner is not yet a fiancee. They do have options other than Jordan and other than a "visa". So, yes, do read the guides but don't propose marriage until after you have a firm, well thought out game plan. You could very possibly make it easy on yourself. We'll all be envious. :thumbs:

wow...thanks for all your speedy replies...i didnt expect anything that quick at all..

I was under the impression that I had to first off fill out a I-129f then a 325 or 354 or whatever it is and send those into the processing center...after that i thought there was a certain set of steps that would follow including interviews and her applying for a visa at the consulate or embassey in Jordan...am i wrong in thinking this?

also what is so unique about the situation? i am not being a smartass or anything i just dont know anything about all of this so thats why im asking...is it because shes in Jordan or has a student visa still or what?

I know that this is the person i want to marry and spend the rest of my life with so what would be the best way for that to happen in the long run..i know that if we get the k-3 visa then we have to get married within 90 days of her being here which to me isnt a problem im just wandering what the drawback are...

Another option im looking into is working for the international branch of my dads companie thts based in london...that would be the easiest but we will just have to see what happens....

one more thing...If i get her here under the pretenses of a visit then have a justice marry us wouldnt she just get deported before we could get things adjusted??....

That is what you would do for K1 fiance visa. That is not your only option.

1. She isn't a fiance yet.

2. She has a student visa and can travel here to visit.

3. The UK passport.

The K3 visa is for married people. K1 is for fiance.

She would only risk deportation if she were the one entering with intention to marry AND stay and adjust status. If you don't propose until she gets here, she didn't enter with the intention of marrying. It would be the same as if you married her before she left. Your false pretenses aren't visa fraud. Hers would be. The proposal must take place after her arrival for a visit, not before.

thanks again for your help...just a couple more questions...

first off, what constitutes her being a fiance? i thought all you had to do was show some written and signed intent to marry and some proof of having met in the last two years...

As for the proof of us having met in the last two years i dont have emails but i have msgs written on myspace and facebook which are dated. I also have pictures of the two of us together but those dont have any dates or anything on them..

also some clarification here. she can visit on her student visa? i thought she had to come back and go to school with that but could not visit? am i wrong in thinking this?? and y would her british passport make things difficult?

One last question...her and i have spoken of getting married and we spoke of it b4 she left to go back to jordan so she obviously knows that i intend to ask her to marry me...but if she came over here for a visit and then i asked her and we got married that would be legal?

Once again sorry for the trouble....I did read the guides and all the info on the uscis website and the state dept site but nothing really cleared up these questions..THanks again, Aaron

Proof of having met in the last two years are things like passport stamps, receipts, photos, boarding passes. Emails constitute proof of an ongoing relationship, which is necessary for the interview stage.

It is possible to file for AOS on other visa types, but only in certain conditions. Your fiance has to be in the country without the intent to marry you and stay. If she does have that intent upon entry on a visa other than K-1, (H1B would be fine) filing to adjust status would then be fraud.

I'm not really sure about the student visa point being that she has graduated already.

If you are intent on filing for a fiance visa be prepared to have her not be able to enter the US for about a year or so since that is how long your process will go.

I'm not understanding why you wouldn't want to go the other route that has been suggested which is to have her visit using her student visa and THEN propose to her. Sure she knows it might happen, etc. but so does everyone else before they get engaged. You would be able to be together in the USA the whole time you do the process. Why put yourself through this unneeded struggle of doing the K-1 (fiancee visa) with her in Jordan if you don't have to? :unsure:

Welcome to VisaJourney! I don't mean to sound negative, but there are only 2 visas to use if you are indeed planning on marrying. The K1 if you are not married in Jordan. and the CR1 (K3) if you do marry in Jordan. Coming on a student visa with the intent on marrying is illegal. I am really suprised that no one has mentioned this yet.

Have you met the family? Are they accepting of this marriage? Have you been to Jordan? (sorry if you said and I missed it, it's early and the coffee is just kicking in)

well she cant come to the US on her student Visa unless she is going to school anyway can she? i mean she is already done with undergrad school and she doesnt want to go to Grad school. anyway the last thing i want is for her to get in any kind of trouble.

I think what will probably happen is either i will go to england to work for the branch of my dads company that is based there and then she will move to be with me or we will go ahead and apply for the fiance visa and just wait the year i know she wants to spend a little time with her mother before she leaves.. and btw yes i have met the family and what mother ever approves of someone to marry their daughter after meeting them only once...her grandmother however is all for us being together so thats nice and i am going over there in september to visit anyway.

Would there be any reason for her not to apply for just a regular visa to come to the US and stay here to work and then wecould get married? or does that take even longer?

With all due respect, she would not be coming with the intent on marrying since she isn't even engaged yet. I think that's all we were saying and I would never suggest anyone commit fraud. If they were already engaged I wouldn't have even brought it up and I dont' think anyone else would have either.

That being said I guess she can't come on the student visa anyways....though I kind of remember that there's a grace period between after she ends school and before she starts again that she could come just from my days working at the university but that's why I suggested going to a lawyer.

Looks like you have plenty of options all which include you seeing her often though so that sounds great! Good luck in your journey! :thumbs:
