Hey all, I am in a tricky situation right now and wanted to get some advice from the community if anyone has been in the same situation or would be able to share any advise on this.

 

Long story short, I have to renew my Malaysian Passport soon and in the renewal forms, it asks to disclose my marriage status. I got married in the US and have received my CR-6 conditional green card, however since it is a same-sex marriage, Malaysia would not recognize this.

 

I initially intended to disclose my marriage status as single (since Malaysia would not even recognize my marriage status) however in order to submit an application to renew my passport, they would need to have a copy of my Green card. In the GC, it says CR-6, which is obvious I am married. However, if I disclose that I am married, I have to state my partners name, which is clearly a male name. Im afraid that by disclosing this, the Malaysian consulate may suspend my citizenship or pursue some other severe measures that would affect my malaysian citizenship.

 

I would like to source some advise from this wonderful community and what you think I should do. Thank you so much in advance!

I would seek local legal advise, if you think about it got to be a long shot somebody on here would have gone through the same situation recently, will now step back and be proved wrong.

Fellow Malaysian here (Female).

 

I received my green card through marriage here in the US. In Malaysia, I am not recognized as married as I have not registered in Malaysia. I have renewed my Malaysian passport since being married at the malaysian consulate without any issue, whereby I declared myself as single (since I did not registered my marriage in malaysia) and also used my green card  (category IR6 = adjustment of status as I adjusted it for the 10 year green card validity). Just to add, I have renewed my Malaysian passport twice - Once with the first green card and another with my IR6.

Day 16 - Oct 16 2014 : Received Biometrics Appointment letter (10/30/2014)

Day 30 - Oct 30 2014 : Biometrics done

Day 80 - Dec 19 2014 : Received Interview Appointment via email (01/22/2015)

Day 82 - Dec 22 2014 : Received Interview Appointment in the mail (01/22/2015)

Day 113 - Jan 22 2015 : Interview at 7:30AM and was approved on the same day, received notification via email/text that application approved.

Day 118 - Jan 28 2015 : Received notification that Green Card has been mailed.

Day 120 - Jan 30 2015 : Received Green Card in the mail.

Day 88 - Feb 04 2020 Interview and Test (8:00 AM) 😃 (approved on the spot! Waiting for Oath Ceremony Date)

Day 89 - Feb 05 2020 : Had to take photo and finger prints again as system was down during interview and test (7:15 AM at same location as interview).

Day 89 - Feb 05 2020 : Received email and text from USCIS that Oath Ceremony date/time/location details has been mailed out.

Day 110 - Feb 26 2020 : Oath Ceremony (8:00 AM)!  🎉🎊🇺🇸 - Registered to vote + applied for U.S Passport!

My marriage is not recognized in Malaysia because I did not register to the Malaysian gov when I got married. When I renewed my Malaysian passport last 2 years via mail, they didn't require my Green Card (which is in my married name). I was surprised with the (lack of) requirement but I was more than happy to not send a copy of my GC. It got renewed fine and was mailed to me in 2 months. 

 

Later this year I found out that the mail-in option is no longer applicable. you'd need to appear in person to renew unfortunately.

10-23-2013: Packet 3 sent

11-19-2013: Interview

04-07-2014: POE Boston

05-07-2014: Got married after 12 years of LDR! :dancing:

@K + R You are overthinking it. Malaysia consulate/ embassy only wants to see green card/ visa to know that you are here in the US legally. Just tell the Malaysia consulate/ embassy that you are single. As far as the Malaysia government is concerned, you are still single as you did not re-register your US marriage with the Malaysia government.

@AliaAlia You can still register your marriage with the Malaysia government anytime- you just have to pay a whopping fine. Registering marriage is needed if you want your children to be able to inherit Malaysian citizenship.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
