N400 with DUI in past 5 years

Dear friends,
I was stupid to get a DUI in Dec '15 and convicted in Aug '16. I have completed all fines and probation. BAC was a 0.13 with no accidents or any damage. What are the current chances of my n400 being approved during my interview that is coming up this February? Can someone share the experiences here please? That would be most appreciated.

Timeline

If you have are married to a US citizen you have to show 3 years of GMC period which starts from when your case was closed. for example. August 2016 to August 2019. and  If you are not married to US citizen than its 5 years which is going to be August 2016 to August 21.

Not currently on probation = good. They cannot approve the N-400 otherwise.

As for the GMC part, it depends on the circumstances surrounding the crime. A DUI itself does not make you ineligible. A DUI with another passenger (especially children) involved might. A DUI while involved in another criminal activity (i.e. driving w/o a valid license or registration) might.

If it was a sole DUI without anybody else involved and there was no other violations involved, it likely will not be an issue for naturalization.

More precisely, the GMC period depends upon what category you are filing under. If you file under the 3 year rule, then the GMC period is the 3 years prior. If you file under the 5 year rule, then it's the 5 year period.

Timeline

You're going to want to bring proof of the fine paid and proof that the probation was completed to the interview incase the IO requests to see it.

If you paid the fine via credit or debit card, bank statement will suffice.  Alternatively, you can get a printout of your DMV driving history which should also show the fine was paid.

 

Single DUI should  not impact the N400.
