I-864: Part 5 - Household Size

Part 5 of the affidavit of support (form I-864) requires information about the sponsor's household size.

 

Question 3 of part 5 says: "If you are currently married, enter '1' for your spouse". The instructions for this question say: "Type or print '1' if you are married. Type or print '0' if you are not married".

 

In our case, the sponsor is married (to me). So according to the above we should enter "1". However, question 3 is under the section: "Persons NOT sponsored in this affidavit", and there is a note saying: "Do not count any member of your household more than once".

 

So if we follow the instructions, and enter "1" because the sponsor is married, we are violating the instructions by counting the same person twice (once as a person sponsored and again as the spouse of a sponsor), and we are counting the spouse under the heading of "Persons NOT sponsored in this affidavit" when the whole point the affidavit is the sponsorship of that very person.

 

Should we write "0" as there are zero non-sponsored spouses, or should we write "1" as the question says: "If you are currently married, enter '1' for your spouse"?

Follow the instructions literally. That section is for those NOT being sponsored in the petition, and the instructions say do not count anyone more than once, so you put “0”. Your spouse was already counted as the immigrant you are sponsoring. Don’t count the immigrant twice

I think this is the correct answer.

 

Though it's not following the instructions literally. It's ignoring the literal instruction of: "If you are married, write 1", since I'm married and will be writing 0.

This question is asked often.  Count the immigrant only once.  Item #3 would be "0".

Small correction.  That section is for people not sponsored "in this affidavit".
