Timeline

Hi there,

 

I'm processing for K1; do I have to do my interview at the consulate in my home country or can I do it at an American consulate somewhere else?

 You give a home address when you file your application, your interview is generally done at the nearest embassy or consulate that processes the type of visa you're applying for.

I'm not a legal resident in Canada but have lived there for a time before coming to the US, so definitely have more ties to that country than my home country. 

 

Can I file a Canadian address as my home address ?

I've heard different things on whether or not you need legal residence in that country, perhaps someone else can weigh in, I'm not sure.

Are you living at that address now? If not then you obviously can NOT list an address that is not your home address, as your home address. That would be called lying.

Right now I'm legally in the US on a non-immigrant visa, but my boyfriend and I wanted to go see my parents before our wedding. It complicates things severely though and I'd prefer not to have to spend 8+ months in my home country where I haven't resided for the last 2.5 years. So I thought I could maybe go to Canada where I first moved.

FYI Montreal is pretty backed up so you probably wouldn't want to try and get an interview there anyways

That is what I always thought and that is what makes sense to me. But I've heard that people interview in countries where they once had legal residence, it expires, but they still live there and interview in that country. Can't verify this, but I've seen it posted by others.

So they live there illegally? Doesn't seem very smart to interview for a US visa while living in a country illegally

I totally agree lol. Wish I could find where I had seen it. Probably doesn't apply in this persons case though.

Well if you are no longer a resident of Canada how would you expect to spend 8+ months there?

 

FYI I just had to spend 9 months in a country I hadn't lived in since I was 5...

Not sure if this is possible but I was thinking as a tourist for six months at a time. I have plenty of friends I can stay with. 

 

Sorry you had to do that. I already dread it even tho I've only been gone for 2.5 years.

If you are in the US on a visa but you were a resident of another country for more then 6 months then you can interview in that country to which you lived more then 6 months in. You don't have to be physically living their if on a visa somewhere else. Since their are no Consulate's in the US that you can interview then Canada is as good of a choice as any other. So if your case is going to another country other then Canada then you must contact the country which your file is going to so that they will send it to Montreal Canada for your processing their. Hope this helps.
