If you are still in the USA you wont be doing a K-1, you will adjust status from another type of visa using I-130 and I-485

The above is correct depending on whether your student visa requires you to return to your home country. If it does, you have another issue to deal with.

The above is correct depending on whether your student visa requires you to return to your home country. If it does, you have another issue to deal with.

My fiance is in the same situation, how can I tell if her Student Visa requires her to return to Ecuador?

08.2006: Entered with a B-2 visa.

07.06.07: Civil Wedding

07.17.2008 AOS approved with interview. It took 367 Days!

11.08.08: Big family wedding

09.18.09-10.03.09: First trip to France with Hubby

I-751

04.19.10: Package sent to Vermont

04.21.10: Delivered in Vermont

04.22.10: NOA date

04.23.10: Check cashed

05.17.10: Received biometrics appointment letter

06.07.10: Biometrics Appointment

06.26.10: Touched

07.07.10: Card Production Ordered!

07.17.10: Card in the mail :) Done until citizenship

It should be written on the visa. I came on a J1 and it said that I wasn't under the 2 years home requirement rule. Just open up the passeport.

If only it were that simple. A lot of J-1s don't have that language on them, and you often have to get a judgement from the DOS as to whether you are subject to the 2 year HRR. In your case you should be OK.

If you are not subject to the 2-year home requirement rule, follow the guides and submit packages I-130 and I-485: http://www.visajourney.com/forums/index.ph...page=i130guide2 If you want to travel or work before you receive your greencard, you will also have to file forms I-131 and I-765. Note that you will have to undergo an immigration medical examination.
