Hi everyone!

 

My husband and I filed to remove the conditions of my green card Dec 2018 and just recieved a letter saying evidence is not sufficient

We sent joint taxes for 2016,2017. Joint health insurance, car insurance. My life insurance that has him as a beneficiary, pictures letters from friends and is not enough they want more.

We always had separate bank accounts and its never been an issue with USCIS before and it works for us, we also rented from a friend for a while and we can have him give as a lease for that time as well. Now my question is, we want to make them happy and send as much as we can. We do have a joint PO Box I can send that as well but my question is......if we go an open a joint bank account now, will that be a problem or thats what they want? We dont mind doing it at all we just dont want it to look worst if you know what i mean? I also have tons of pictures from this summer weddings we attended etc that im planning on sending but i think we dont have enough of what they want and I want to get this moving asap since its already taking sooo long. Any advice is much appreciated =)

Do you have a joint phone plan?  Other bills?  Gym membership?  You can start adding him to those things.  I had friends do that, adding the spouse later.  They got approved but it took work. Also trips together can help.

No, we dont share a phone plan...but we are happy to join everything if its what USCIS is looking for. My husband is recovering financially and i have great credit so we kept our finances separately but we can get joint accounts if we have to, im just not sure it will be enough? We will do what it takes we have nothing to hide

Is your husband an authorized user in one or more of your credit cards?

How about a retirement account, yours or his. You can print a document that shows the other as beneficiary.

I would also add 2018 tax returns, filed jointly.

You said you rented from a friend for a while, where do you live now? rent own? Proof of shared residence would be good.

 

I would not try to create evidence at this point, since an empty joint account doesn't really mean much.

Did you send them proof of car/health/life/renters insurance all the way back to your marriage? You don't need to send them every month's statement, but every other or once a quarter should be enough.

Do you have any proof of travel together? (tickets, hotels, airbnb, uber, visa etc)

Have your friend write a letter stating you were renting from him and the dates.

Send 2018 W-2, tax returns from IRS. Did you send the IRS tax statement for 2016, 2017?

Do you have medical bills or any other stuff being delivered to the same address for the past 3 years? Send some proof of that.

Does your drivers license have the same address? send a copy of it for both of you.

 

I'm in the same boat as you. We got a RFE a couple of days ago and I sent them additional info. We don't share joint checking accounts or phone either.

Also, could you share what exactly the RFE asks you to submit?

Hi!

Thanks so much! I looked into what you sent and I feel terrible now since you have much more evidence than we do. We never had joint accounts and when we went for our interview when we got married this wasn’t an issue and the whole process was like a walk on the beach so easy! Now I’m freaking out

 

I sent our joint car insurance, joint health insurance, 2016 and 2017 taxes, my health insurance showing him as a beneficiary, we sent copy of our drivers licenses with same address on it, I also sent 2 affidavits from friends and pictures. 

 

Now they are requesting more on the financial side, they want lease joint accounts a will etc...and we don’t have that! We don’t have much money we don’t travel we camped this summer and we went to a wedding together out of town I have pictures to send not a plane tocket

we have taxes for 2018, we changed car insurance companies we got that as well, my friend will write a letter that we were living with him, my husband has worked under the table for the last year and we just bought a home that only under my name since he didn’t look good on paper, he just got a new job and we are waiting on his credit to recover to add him to the deed and the mortgage, should I send a letter explaining that? 
I’m so frustrated they can come over and join us for dinner if they want I have nothing to hide but now I don’t know what to send!

my friend said to join accounts at the bank add both names to utilities and send that  with the rest of the stuff we have and hope for the best?  but I want to cry 
We are planing on going on a trip next may but of course I have no tickets yet to anywhere 😫😫😫😫

You can't go back in time and create what you don't have. Just worry about what you do have, and provide all of it. We all freak out every-time we have to interact with USCIS. I too am freaking out what they'll do with my RFE response that was delivered 6 days ago.

 

If he's not on the home mortgage, is he on the insurance for the house? You could send that document, along with a letter explaining why his name isn't on the house mortgage.

Explain how your finances work in the letter you write. Include checking account showing transactions of you paying rent/mortgage/bills.

You could add his name to your utilities. My spouse and I don't have both our names on any utilities, although she gets the water/trash/sewer bill in her name, and I get electric and internet. Do you have any bills like that?

You could add each other as authorized users on credit cards.

Did you you both get an invite to the wedding? You could include copy of that invitation.

Do you guys have a 401k or something? If you do, you could show documentation that you are each others beneficiary.

Did you send health insurance for all the years you were married?

State/Federal tax transcripts from IRS and state tax authority?

You have not provided proof of cohabitation - they need joint deed, or mortgage or lease/rental agreement

 

They need addtiional proof of comingling of finances - joint assests or liabilities - credit cards, utilities, phone bills, internet bills.

 

I think you are stuck on the fact that provided a lot - it is not according ot USCIS. Get over it and provide what you can.

My concern is honestly if it will be enough if we now get joint bank accounts and add him to utilities or if it won’t? I can’t send what I don’t have or had before I can only look forward but I’m worried about not being sufficient for them

Thank you! We will make sure both names are on all utilities and bank accounts from now on.

I will send our 2018 taxes; new car insurance, pictures from this summer, I don’t have the wedding invite but I took some pictures of the table setting with both our names at same table? He was the best man at this event we have the hotel bill will that help?

Also some people told me not to answer more than they ask, so I don’t know about the letter? I’m freaking out! My husband is super chill and is not worried but I’m stressed

Your current goal is to provide sufficient proof to USCIS that your marriage was entered in good faith and that you have remained in a bona fide marriage for the entire 3 years or so. What exactly does the RFE ask for? This is your chance to provide USCIS evidence that your marriage is real and genuine. Go line by line on your RFE. Provide EVERYTHING they ask for unless you don't have it (Child for e.g.). Then write a letter explaining why you are unable to provide what they ask for (Don't have a child, dont have 401k from employer, was not on an official lease but affidavit from landlord attached, etc.)

 

You have to provide proof of cohabitation. How did the rent get paid? Did you both pay your friend rent, or just you/your husband? Did you write a check to your friend? You could include proof of payment(from your bank statements) that rent was actually paid.

 

You recently went to a wedding. Do you have pictures with other people there? Can the bride/groom write an affidavit. Mind you, affidavits are nowhere near as good a proof as financials/comingling (lease,mortgage,bank accounts,401k,life insurance, health insurance).

 

Just my 2 cents.

Make sure in your reply that you address each item they have asked for. If you do not have children then write and explain that. If you do not have joint utilities write and explain that. If you do not have joint lease then write and explain that. Do not ignore items in their request and think that just providing what you have will be enough.

 

Not having items in their list is not a deal breaker but they need to know that you took their request seriously.
