i-864 for sponsor and joint sponsor

Hi friends ,

Quick help please . I am filing i-864 as a sponsor for my spouse and my brother is going to be the joint sponsor as I don't have a job at the moment.

So do I need to file two i-864 ( one me as a sponsor and one my brother as the joint sponsor) or I need to add my brother's details in the original i-864 I am filing as the sponsor. I am confused because form i-864 has an option on the 1st page which says "I am the only joint sponsor" and we also need to fill a i-864a form since I am using his income for sponsoring my spouse.

 

So it going to be i-864 (sponsor) + i-864(my brother's details)+ i-864a( my brother's financial details ) ?

You have to file your own  I-864 and mark option 1a since you are the petitioner for your spouse.

And your brother is the joint sponsor so he needs to file I-864 separately and mark 1.d as he is going to be the only joint sponsor.

I-864 a is used if you are using a household member’s income. If your brother lives in the same household then he needs to use I-864a and you need to mention in your i-864 form that you are using family member’s income.

Not so much.  Since this petitioner has no income, there is not combining of income.  When a joint sponsor qualifies on their own, they are not mentioned at all on the petitioner's affidavit of support.  The joint sponsor completes a separate affidavit.  If the joint sponsor is married, filing a joint tax return, then his spouse provides an I-864a whether she has income or not.

Facts are cheap...knowing how to use them is precious...
