Visa application refusal

Hello, we had our interview in Kingston Jamaica on July 8, we received a 221g white slip to send in court documents and waiting for medical. We were in AP for 2 months we received a visa application refusal on September 9. I called and emailed the embassy they would not give me any information about the reason for refusal.i contacted uscsis they told me a refusal and denial are different and I should get a letter explaining why he was refused in 60 days. My question is are visa refusals and denials different and what are our options?

I can’t speak to if refusals and denials are the same for certainty (I only assume they are the same) but it appears your next step may be to move to Jamaica to be together or get married and file a spousal visa. I think when you get the letter you will have more insight.

A visa is either issued or refused.

A refusal can be overcome - either by subsequently becoming eligible for the visa (i.e. if documents were missing, additional processing was necessary, etc.) or by waiving an inadmissibility (if that is the cause for refusal).

 

The online status may or may not just be delayed in updating the original "refusal" status. If it is actually refused, you should get a reason why,

USCIS has no say at all in the visa process. They handle the petition. Petitions are approved or denied.

I can not move to Jamaica I have children here that I would be separated from and his situation in jamaica wouldn't work. at the moment.

Keep at it with the embassy to obtain a reason for refusal. They are required to give a reason (even if very vague....like a section of the INA).

That will tell you what the next steps can be.

So basically either wait for a letter or a email response from the embassy? I saw they updated it today again as well. Thank you for responding, do you happen to know how long the embassy takes to send a leotter?

I do not know how long they typically take at that consulate, sorry.

So was there something in the court documents or medical that made the applicant inadmissible?

yes  but I don't know the reason for sure
