Still No Reply April Filer?

Hello all! I posted on a separate thread as well but hoping you fine lovelies can share some experience and light my way. 

 

We are from the UK (well my fiance is) and we received NOA1 on April 19th. I have been looking all over this site and people from the UK that filed after us have received NOA2's already. I'm starting to get concerned?? 

 

I was advised by Rapid Visa (which is who we used to help assist) that it went to the California service center, however I tried to inquire with them but this late at night it's their international staff I believe so she didn't have much information to provide me. 

 

If anyone can assist at all? We're very anxious to go home (well home for me, as I'm in the UK on a Tier 2 Work visa, and hoping that it doesn't expire before we get approved to go)

You're still within normal processing timeframes, although some others have been processed more quickly. It happens (think of a massive grocery store with hundreds of checkout lanes, not a single line). Hopefully you hear back soon.

 

All I-129Fs for a fiance are processed at CSC (with a very limited number of cases later being transferred to VSC).

 

You can check the status of your case by receipt number online. Try both as they are not always in sync:

https://myaccount.uscis.dhs.gov/ (login/account required)

An alternate option is a quick marriage in Gibraltar and then filing an I-130 directly with the USCIS London office: https://www.uscis.gov/about-us/find-uscis-office/international-offices/united-kingdom-uscis-london-field-office "Form I-130, Petition for an Alien Relative" tab

What does it say on your NOA1?

It’s from California... which makes me worry more since again later filers are already further along

We’ve already paid for rapid visas services and gotten this far. Wouldn’t that change everything?

Yes. But the London office tends to be quick: https://uk.usembassy.gov/embassy-consulates/government-agencies/dhs/uscis/i130filing-html/ "The London Field Office generally adjudicates cases within 90 days of the filing date."

And Gibraltar law just requires a one night stay before getting married: http://www.visitgibraltar.gi/getting-married

Right around the time you submitted your application the time period was much longer. USCIS was able to add staff which brought a 8 to 12 month adjudication time down to about 3-4 months is where we are today. The increase staffing started working on "new" cases rather then work on those that were in the process, that had been started. I truly believe that this is what happened to you. There isn't anything you can do because technically your still within their normal processing time.
