I-130 approved, I129F/K3 still pending. What now?

I've seen some patterns where after you get the "pending" notice, it takes a bit over a month for approval.

I-130

2007-03-17: NOA1

2007-06-01: Approved

I-129F (K-3)

2007-03-26: NOA1

2007-06-01: Approved

2007-07-26: Interview at Consulate

2007-08-06: US Entry

AOS

2007-10-31: AOS NOA1

2008-04-04: Green Card received.

Removing conditions

2010-01-19: Filed I-751

2010-01-26: Check cashed

I've seen some patterns where after you get the "pending" notice, it takes a bit over a month for approval.

I hope that'll be the case vikasp. My husband just sent me an email and he said that he called VSC and he was told that they are reviewing our k3 application now and that we should be hearing from them within 30 days or sooner. YAHOOOOOOOOOOOOOOOOO!

Got an email today that my I130 on behalf of my wife was approved on 5/31. The I129F/K3 still shows as pending. Does this mean now that I should abandon the K3 visa, or will this be put on hold automatically (as it would happen the other way around if I130 and I129F are approved at the same time)? Also, is there anything I need to do when the actual NOA2 notice arrives? I'm asking because I'm in Germany at the moment and had not planned on being back in the US until June 21st (i.e., about two and a half weeks from now).

This is a good question. My wife is convinced that the I-130 is faster than the I-129f. Also, since they're raising the fees, it will cost $1000 to change status once she gets here if she comes on the K-3. Is it really that complicated to go with the I-130 if it's approved first?

I don't think it's complicated. I think it's a matter of being patient. My husband just want us to be together and likewise that is what i want too. Besides, we are hoping we can celebrate our birthdays together. That is what we're after. Yes they have raised the fees however, being together as soon as we can is more important to us.

Your petiton will not be abandoned unless you call the NVC and tell them that you want to abandon it. If the I-130 makes it to the embassy first, your I-129F will be abandoned by them. K3 goes through NVC really quickly, for me it was only a few days.

CR1/IR1 has a long ways to go, once it is at the NVC. Forms have to be filed, fees paid, more paperwork, and then after a while, it will get forwarded. So there is still a fat chance that your I-129F will make it to the embassy first. Also, in Germany, you will get an interview rather quickly after they get your stuff

Update:

I got back from my trip to Germany yesterday and actually found the NOA2 letter for the I130 approval in my mail. (The letter doesn't say anything more than what the email had said already.) I just checked the I129F status and it still shows as 'pending'. Also, I just called the automated NVC help line. They had received the I130 on 6/11 and they have assigned a case number. The message also said that the beneficiary (i.e., my wife) can expect to be notified within 4-6 weeks of the receipt date. No mention that I would be receiving anything. I'm a bit confused about this: I thought I should be receiving things as well (AOS bill, etc., etc.) assuming that now the usual IR-1 visa route applies since the I129F/K3 petition is still sitting at VSC. Or do I misunderstand the process?

Some clarification would be much appreciated. Thanks.

At this point, I think you should only pursue IR-1 route. You can send a postal mail to the appropriate service center where they have your I-129F petition and request them to cancel your I-129F process. On that letter, you can mention that your I-130 is moving well at the NVC and therefore you want to concentrate on I-130 only. If you want, attach an I-130 approval notice's photocopy.
