Im on fiancee visa k1-k2 from philippines, we just got our u.s visa last may of this year..i just need someone to clarify me,because me and my daughter are going to the u.s on july..my question is, do i need to secure a letter from my daughter’s father even if my daughter is 8 years old willing to go with me in the us and shes in my custody given to me by our annullment verdict.my ex husband and i are not in good terms and he is hard to talk to. I dont like to ask him for a letter. I know here in the philippines we have different family code in here unlike in other countries..can somebody please give me a clear view on this? If someone have same experienced like me..

I would say if you can prove you get the legal sole custody it could be fine... otherwise you'll need to provide them a notarized letter of consent from his father.

Being you were married and the child is not illegitimate the answer is not a cut and dry "NO".  You may want to consulate the attorney that completed the annulment for you.     If the annulment documents give you full custody of the child I don't see any issue.

As long as you have custody of her then according to Philippine law you can do with her as you please.

Yeah someone have told me also that i dont need a letter because i have the custody of my daughter in my annulment..but just like to clarify it.thank you for taking your time to answer.🙏
