Online N-400 - Attach marriage certificate

I am applying for N-400 online after 5 years of permanent residency. I received the GC through work and not marriage.

 

• In the required evidence, the system asks me to upload a copy of my marriage certificate.
• I have no issues with uploading the marriage certificate but am confused as to why this is in the required evidence tab since I didn't get the GC through marriage.
  • I thought the only evidence which would be required for me would be a copy of the GC
  • I just want to make sure that their online system is not classifying me in the wrong category for GC. I checked the box which said I have been GC holder for 5 years
• Has this happened to others applying after getting a work based GC?

You have to verify your marital status, whatever it is. If you say you are married, then they require a copy of your marriage certificate as proof.

As what Hypnos said if your status is married then you have to provide proof of that which is your marriage certificate, regardless if you got your GC thru employer, it's a proof of marital status so documents should be provided.

As of the evidence section, you can provide your past 3 years tax transcript.

Can I upload the tax transcripts a few weeks later or should I upload them before filing the application?

It is advisable to upload them before submitting the application. You can download the tax transcript online. got to the below site and download them:

No, it is also applies under 5 year rule whether the green card obtained thru marriage or employer. USCIS wants to make sure you dont owe anything to the IRS and if you're filing taxes religiously.

I am concerned about the time it will take to get tax transcripts. In order to not delay filing, could I do either of these

 

1) File online now and upload tax transcripts in a few weeks. I thought one of the benefits of filing online was that it was easy to attach more evidence over time.

 

OR

 

2) Take tax transcripts to the interview.

 

Does USCIS have issues with looking at evidence which is uploaded a few weeks later after the initial filing? I would have thought that it would be a while until anyone looks at the application other than getting the biometrics appointment

Again tax transcript can be downloaded online, not sure why you don't want to do it. It's pretty easy unless you have problem with tax filing and that can be addressed prior to the interview.

I disagree here! Under 5 year rule you are not required to send marriage certificates and tax return transcripts. You are required to take those to your interview though. My friend got approved last year on 5 year rule (work-based PMR) without submitting those. Personally I applied in February under the same rule. I didn't submit those either although I'm still waiting for interview. Read the evidence check-list / requirement on USCIS website.

Did you apply online or paper based? The system wont allow you to continue if you did not attach the required supporting documents such as marriage certificate, the tax transcript can be showed during the interview, but the marriage certificate is required whether the green card was obtain thru marriage or employer, and if you choose married as marital status.

Yes, online. I do remember struggling with the system a couple of times but eventually I was able to continue. The only thing is that you get an orange alert that if you don't upload a required document (something like that) your application may be denied. I only uploaded copies of green card and birth certificate for my dependent child who lives abroad as well as evidence of financial support per the check list. Hopefully, if and when I go for interview I'll give you all a more personal story.

Well I guess USCIS added some security on their online application based on OPs experienced. OP's can't submit the application without the supporting documents of marital status.

USCIS highly recommend to add supporting documents to avoid RFE or delayed on the application, though supporting documents can be provided on the day of the interview but that is added checking on the IO job since it needs to be checked prior the approval, so the approval would be delayed as well. Where in fact the uploaded supporting documents along with the application can be checked before the interview so the chances of same day approval will be high.

It's possible they added more stringent measures afterwards. My wife too applied with me. Same story. I hope that's not why we are yet to get interviews! LOL!
