The Visa Bulletin has nothing to do with I-130 processing. You need to check the USCIS processing times website for that: https://egov.uscis.gov/processing-times/

There are very limited exceptions for a few work visas (e.g. H-1B, O-1, L-1). Given that the child is under 21 (for F2A category), these exceptions very likely do not apply.

That is incorrect. A parent of a USC enters the US on B1 visa can do a I-485 adjustment of status. It is not fraud as long as there is no misrepresentation at point of entry. Many folks here on visajourney have done a B1 adjustment of status for parents of USC.

No, it is very correct. I made 2 statements:

1) You cannot file for AOS for somebody not within the US.

This is absolutely true...I think we agree there.

 

2) It is fraud to use a non-immigrant visa as a means to immigrate (file for AOS).

This is also true. A requirement to obtain or use a tourist visa is intent to return home. See INA 212(a)(7)(a)(i)(i). People have been refused fore this reason. Some have received an expedited deportation at POE for this.

This is different than filing for AOS after entry on a tourist visa. Circumstances can change and result in deciding to file for AOS after entry.

My husband's i-485 application was accepted along with his working permit form!

Now the wait begins. 🤩

 

We are so excited, the wait is still long but this is a marvelous first step.

No - the I-485 can only be filed if they are already in the US. They cannot enter with intent to file for AOS either.
