How is the age requirement for under 21 determined?

My mother and father inlaw are permanent residents on a 10 year green card here in the usa.

They have been here in the usa 2 years now.

They would like to file i130 for the son who will be 21 on October of 2019.

At what age does uscis determine if he is under 21?

At the time uscis received the application for i130 or when and if the i130 is approved which will probably be after the sons 21 birthday in October?

If after age 21 does that mean their son will be on the 15 year waiting list?

When the visa number is current and as adjust by CSPA.

 

Yes the petition will move to over 21 and a lot longer wait.

Unless the petition is pending for all but ~5 months while waiting for the PD to become current, they will age out into F2B w/ a 7+ year wait.
