Interview failed: where to send interview day documents we were missing?

My French husband didn't pass his interview in Guangzhou yesterday because my joint-sponsor had filled out the wrong form.  They gave us a list of forms to send, and there's no instructions on where to send the forms.  When I looked up the form I-864 on the USCIS website, it gives a Chicago address under "Where to File."  But we are working with the consulate in Guangzhou. 

 

So do we send them to the Chicago lock box or to Guangzhou? Unfortunately, it's the beginning of the weekend (Friday), and I can't ask the Guangzhou consulate.  But the CITIC bank will be open tomorrow (Saturday), and if I can send the forms tomorrow, I want to.

 

Also, if anyone has had similar experiences, it would make me feel better to hear about them...  From reading the posts, it feels like we're the only ones who blew the interview.

Yes, send them to Guangzhou... if you are doing a DCF, all of that stuff goes to the Embassy there. Those lockboxes (Chicago and such) are used for people filing in the states.  You didn't blow the interview, it is just unfortunate the paperwork wasn't correct. Did you get a 221 form saying what you need to do to correct the problem?

Thanks.  Yes, we got a form, and apparently, we also didn't get a tax transcript, and that will take five to ten days to process.  The form he was given says that, if the interview doesn't go well, the processing time could take 60 to 120 days, and we only have 30-so more days that we can stay in China.

 

I'm looking into whether he can finish this up in the consulate in France.

Very true, but when I attempted this, in order to get them online you had to provide a U.S. based phone number with the mobile account registered in your name. That effectively makes it impossible to use a relatives number or a friend. Because of that, I had to order the tax transcript... and furthermore, they send the tax transcript to the address of your last filing, which if it is in the U.S. (mine was in Hawaii), necessitates your having to get someone to send it to you via an express service like DHL. For me, it took a little under 3 weeks to order the transcript, have it delivered to Hawaii, then to get someone to send it from Hawaii to where I live.

It looks like our journey will be one whole year longer.  The processing time seemed like it could possibly take too long, and we can only legally stay in China with our work visas until July 11th.  If his passport with the visa hadn't come back in time for that, we would have been screwed. 

 

So we are signing another year contract with the school we work at.  We are very lucky that they had spots free for us.  But I still feel like a failure.  Such a long struggle this has turned out to be!

 

Do you have experience in this?  He has taken the medical exam, and that expires in six months.  The form we were given after the interview said we had a year from that day to turn in all the missing forms.  So does this mean we can take the medical exam again, say in March or April of 2020, and then he has the visa as we stay in China the last four or so months?  We shouldn't have to pay any of the fees we paid or turn in new forms?

Sorry no idea. You are treading into areas of the GUZ consulate that I have no idea of policy/procedure. We had more than enough fun at the GUZ consulate getting K1/K2 visas for my family back in 2012. For certain, voice your specific questions to the staff at the consulate. Another idea is to have your thread moved over the China Regional Forum. There are some seasoned (and lightly breaded 😆) souls that check in there every once in awhile, they may have some valuable insight.

The visa application is only good for one year, after which you would need to reapply (I-130) - unless you can work with the consulate to keep it alive during that time. I expect that it would be possible to do this, but don't know.

 

Yes, you will need a new medical and police report.

 

If they are SPECIFICALLY asking for IRS-issued transcripts, you can have your friend in Hawaii scan them and send them to you. Also, I believe you can temporarily register your friend's US phone number and use that to order the transcripts online.

 

If they are NOT specificallty asking for IRS-issued transcripts. send copies of your tax returns as submitted.

Your local PSB should be able to work with you on your visa needs, if you haven't already signed the contract.

We have actually already done that because we filed the I-130 about a year ago, already.

You will need to RE_APPLY if it expires. After one year, they toss your file, unless you are working with them.

PSB is Public Security Bureau Entry & Exit Bureau - they issue visas locally.

You will need a new medical, but you will not have to pay the visa application fees again, as long as you submit the requested documentation within a year of the interview, since you are merely continuing with the same visa application.  If they want any of the other forms updated (for example, the police certificates), they will let you know.  You may want to contact them and ask about this about the time you get the new medical.
